Default Dan Sullivan, called System Suck by Greg et al ... Saratoga County's Child Protective Services Abuses Another Family.

fx, this is very important information to relay. Though two posters in
this newsgroup, between them, researched this relatively unknown (at
the time) premmie brittle bone disease, (Dan) and the other mailed a
notice to all CPS and state's attorney's general about this it appears
that at the time of this article being printed at least one state did
not recognize the need to read and understand what they had
received....or someone round-filed my post.

And my posts were sent by registered letter, not e-mail.

Do you find it odd that given the work of both Dan (he's the real hero
of this story...because he used the information he researched to help
overturn a removal and get Loyal Fan's precious daughter returned to
the family) and myself, that Greg would persistently refer to us as
System Sucks, and pretend we don't help families that come here for
support?

Do speak to him about this. I can't speak for Dan, but for myself, it
really hurts my feelings.

A bit of history. In Nov of 2003 Dan produced a link to some research
he found that showed a NEW and only recently explored variant of OI
that was seen mostly in children who were born prematurely.

And he posted the report on it. I made it my task to inform all state
governments of it. Not JUST CPS but the state's attorney's general as
well...since this is a legal issue for families and the state.

You might wonder what prompted this post.

Well, it has to do with letting the silly ****s here, you included,
dig yourself a deep enough hole.

I decided long ago to let the "System Suck" lie play itself out, and
now, little ****ant, and Greg your littler brother, the chicken's, as
they say, are coming home to roost.

Child abuse claims were baseless, justices rule in Saratoga County case

ALBANY- A baby girl who suffered mysterious bruises and broken bones
will be returned to her Saratoga County parents, a state appeals court
ruled.

In 2004, Saratoga County Family Court found "Julia BB's" parents guilty
of child abuse and removed the 5-month-old girl from the family's home.
But the Appellate Division of state Supreme Court overturned the ruling
on Thursday, saying the two doctors who testified against the parents
wrongly attributed the girl's injuries to child abuse.

"There was a rush to judgment on both the part of the Department of
Social Services and the doctors," said Laurie Shanks, an Albany Law
School professor who represented the family.

The appellate court ruling said one doctor was inexperienced and the
other was on a personal crusade.

The appellate court cited testimony from a court-appointed psychologist
who said Julia's parents were warm and nurturing and "would be very good
instructors in a parenting class."

The court withheld the last name of the family to protect the identity
of the child.

Julia's story began in November 2003, just weeks after her birth. Her
mother took her to the family pediatrician with purple marks on her
back, chest and leg. The bruises came and went, and the pediatrician,
Dr. Sushil Sood, testified that they did not progress from black to blue
to green to yellow, but rather, appeared as small blue dots that would
disappear in a day or so. Julia showed no signs of pain.

From there, a chain of events begins that lead to Julia's removal:

Julia's family brings her to the doctor repeatedly with signs of bruising.

A full-body skeletal X-ray shows a skull fracture and fractured ribs,
left forearm and left tibia.

Tests for osteogenesis imperfecta, better known as brittle bone disease,
are negative.

Child Protective Services begins an investigation.

Dr. James Slavin, an orthopedic surgeon, examines Julia and deems her
injuries are the result of child abuse.

Julia's grandmother moves in to help care for the girl and her two older
siblings and tells the court that the parents carried the baby on a
pillow to protect her.

Emergency medical technicians respond to a 911 call at Julia's home and
find Julia spitting up mucus. Dr. Javier Sanchez of Albany Medical
Center concludes it was a "smothering incident."

Saratoga Family Court Judge Gilbert Abramson rules that the parents
severely abused Julia and neglected the two older children. Julia is
removed from the family's home March 2003.

The appellate court on Thursday ruled there was no evidence that Julia's
two older siblings were abused, and that the Family Court abused its
discretion by denying the motion to reopen the case to hear testimony
from two additional medical experts.

Subsequent testimony of new doctors said Julia suffered from a variant
of the brittle bone disease that cannot be tested for. The doctors also
stated that Julia's parents repeatedly sought medical help for Julia and
consistently took her to the same doctor, which is not the behavior of
parents trying to hide abuse.

The appellate court said Sanchez' lack of experience and Slavin's
"transition from the role of physician to advocate and his resulting
crusade ... all but eviscerates the value of their medical testimony."

Shanks, the family's lawyer, said Julia's mother teaches at a college
and her father is a business executive. Shanks said they have spent all
their money trying to get Julia back.

Julia "has loving parents who attempted to get her the absolute best
medical care that they could, and as a result, Child Protective Services
intervened in their lives and ripped their child from their home,"
Shanks said.

Julia, now 3 years old, will soon be returned to her parents.

It is sickening how many children are subject to abuse, neglect and even
killed at the hands of Child Protective Services.

Imagine that, 6.4 children die at the hands of the very agencies that
are supposed to protect them and only 1.5 at the hands of parents per
100,000 children. CPS perpetrates more abuse, neglect, and sexual abuse
and kills more children then parents in the United States. If the
citizens of this country hold CPS to the same standards that they hold
parents too. No judge should ever put another child in the hands of ANY
government agency because CPS nationwide is guilty of more harm and
death than any human being combined. CPS nationwide is guilty of more
human rights violations and deaths of children then the homes from which
they were removed. When are the judges going to wake up and see that
they are sending children to their death and a life of abuse when
children are removed from safe homes based on the mere opinion of a
bunch of social workers.
