Girl, 15, guilty of killing newborn

A 15-year-old Sauk Village girl who suffocated her newborn daughter so
her foster mother would not find out about the birth was found guilty
Wednesday of second-degree murder and concealing a homicide.

The girl, who had been cited in a juvenile petition for first-degree
murder, stood quietly before Cook County Juvenile Court Judge Michael W.
Stuttley in Markham as he announced his verdict. He rejected the charge
of first-degree murder but found her guilty of the lesser charges.

Afterward, he gently asked her how she was doing. "Things going good for
you?" he said.

"Yes," she murmured.

"Doing OK in school?"

"Yes."

The verdict came after a 20-minute trial in which both sides agreed on
the evidence in the case.

About 3 a.m. on Oct. 25, 2006, the defendant's 13-year-old sister got up
to use the bathroom but found it occupied, said Assistant State's Atty.
Terry McGinnis. The sister forced her way in and found the defendant,
who was 14 at the time, sitting on the toilet with the baby inside the
toilet bowl.

The 13-year-old, who had a newborn child of her own, cut the umbilical
cord and wrapped the baby up and put a hat on her head, McGinnis said.

They fed the infant some formula, then burped her, and "when the baby
started to cry, [the defendant] put her hand over the child's mouth,"
saying she was afraid her foster mother would hear, McGinnis told the judge.

The 13-year-old warned her sister not to do that and then put the infant
to bed with her own child.

"[The sister] said she was afraid to give the baby to [the defendant]
because she was afraid [the defendant] would hurt the baby or put it in
the trash," McGinnis said.

About 7 a.m., the 13-year-old returned the newborn to the defendant, who
later left for school. When the 13-year-old went to find the child, she
was unable to do so, McGinnis said.

The sister said she left the home, and when she returned about 3 p.m.,
she asked the defendant where the child was and was told she was in a
trash can in the garage.

"[The sister] tore open a black garbage bag and found the dead baby,"
McGinnis said.

Police were called, and in a videotaped statement the defendant told
investigators that the baby was crying and she was afraid the foster
mother would find her.

"She covered the baby's mouth with a blanket for three to five minutes,"
McGinnis said. "She said she knew the baby had stopped breathing and was
probably dead."

Assistant Public Defender Presita West told Stuttley her client didn't
even know she was pregnant until she felt labor pains in the bathroom
and realized she was giving birth.

The defendant and her siblings had been removed from their biological
parents' home years earlier by Department of Children and Family
Services officials for excessive corporal punishment and other abuse,
West said.

Imagine that, 6.4 children die at the hands of the very agencies that
are supposed to protect them and only 1.5 at the hands of parents per
100,000 children. CPS perpetrates more abuse, neglect, and sexual abuse
and kills more children then parents in the United States. If the
citizens of this country hold CPS to the same standards that they hold
parents too. No judge should ever put another child in the hands of ANY
government agency because CPS nationwide is guilty of more harm and
death than any human being combined. CPS nationwide is guilty of more
human rights violations and deaths of children then the homes from which
they were removed. When are the judges going to wake up and see that
they are sending children to their death and a life of abuse when
children are removed from safe homes based on the mere opinion of a
bunch of social workers.
