Hello, I need some help with my situation. I live in the states with my
husband and daughter. My ex who is my daughter's father lives on Guam.
The courts on Guam ordered him only to pay $50.00 a month for child
support which he only started paying from August of last year. He still
owes me from part of 2001 thru 2002 up to July of last year. I also want
an increase because $50.00 is a joke to support a child. I'm going to
school while my husband is working. My ex still calls to speak to my
daughter and recently told me he's leaving to join the military. Could I
still try to modify the court order even though he'll be leaving soon and
could I still get the child support he owes me from the past years? Please
help!

One thing you stated doesn't sound quite right. The CS laws in the U.S.
allow the state where the child resides to have jurisdiction for setting CS
awards. Were you and the child residing in Guam when the original CS award
was ordered? Did you violate the Guam court order by moving the child from
Guam to the states? If you moved, have you lived in your current state for
6 months or more to establish legal residency?

You can ask for a CS modification at any time as long as you can show a
substantial change of circumstances. The fact you are going to school and
your current husband is supporting you will not matter. You will have an
income imputed to you at least as high as the minimum wage and maybe higher
if you have job skills that would allow you to make more working at your
level of potential income. Going to school is not a valid reason for not
working full time. Collection of any past support can be accomplished by
having the existing order run through your current state's IV-D program as
long as Guam is party to international CS laws.
