Colonna Implications for Dads?
NCP dads who think they might benefit from the Colonna case should realize that
this decision was based on a "disparity of income" where the CP's income is much higher than the NCPs. This rarely happens. The case may result in an avalance of cases w/NCPs requesting consideration of their ongoing expenses for the childrens' visits but, in my opinion, the PA SC has (as usual) made its ruling sufficiently narrow to preclude it from being used as precident in those cases. The irony, in "our" case, was that there was a great disparity of income--after we were ordered to pay 1200. a month in support. Her net was twice what ours was. But, as I have stated before, if ours were a PA case, our support would have been less than half what we paid to FL. due to PA's disparity of income clause. For better or worse, the PA legislature attempted to equalize the standard of living/contribution for all the children a parent helps supports. This was before the Colonna case.
