Girl's Drowning Ruled Homicide; Parents Had Lost Custody To Aunt By COLIN POITRAS | Courant Staff Writer September 19, 2007 http://www.courant.com/news/local/hc...0,629112.story GROTON - A 2-year-old girl found drowned in her aunt's bathtub Sunday had been temporarily placed in the relative's home because of concerns about her parents' ability to properly care for her, sources said Tuesday. Treau Bemis died of asphyxiation due to submersion in water, according to autopsy results provided by the chief state's medical examiner on Tuesday. The manner of death was given as homicide. Craig Betancourt, the 32-year-old boyfriend of Treau's paternal aunt, Kimberly Ann Bemis, was charged Monday with murder and capital felony. The latter charge relates to the killing of a child under 16. If convicted, Betancourt could face the death penalty. Betancourt, a cook at a Groton fast-food restaurant who lived with Bemis at 164 High Rock Road, was believed to have been babysitting the child while Bemis worked at her job at the casinos, sources said. Betancourt called police about 10:20 p.m. Sunday night to report the unconscious child and later confessed to the killing, police said. He could not post $3 million bail and was being held pending an appearance in Superior Court in New London on Oct. 9. State child welfare officials said that Kimberly Bemis filed papers to obtain custody of her niece in probate court in December 2006. The court asked the state Department of Children and Families to conduct an assessment of Bemis' home prior to placing Treau there. State social workers did a routine criminal background check and reported to the court that Betancourt had a criminal record but the charges were related to arrests that were 10 years old and did not involve any violence against people or children, according to Gary Kleeblatt, a DCF spokesman. Those arrests included a felony reckless endangerment charge in 1995, a minor larceny charge in 1996 and a charge of failing to appear in court in 1995, sources said. The endangerment charge is believed to have involved Betancourt firing an air gun, sources said. State workers also reported that neither Betancourt nor Kimberly Bemis had any prior charges of child abuse or neglect, Kleeblatt said. Based on the DCF report, the probate judge granted temporary custody of Treau to Kimberly Bemis in March of this year, Kleeblatt said. In June of this year however, DCF investigated a report of neglect regarding Treau and her mother. The Day of New London identified the child's parents as Loretta Stollar-Bemis and Timothy Bemis. The allegations are believed to have included Stollar-Bemis' arrest on a charge of driving while intoxicated with children in her car, sources said. That case remained open at the time of Treau's death. Timothy Bemis on Tuesday said he has hired a lawyer regarding Treau's death and has been advised not to discuss the matter. Kleeblatt said DCF is launching its own investigation into Treau Bemis' death and whether her case was handled properly. Such reviews are mandatory any time a child with an open or recently opened DCF case dies, he said. Contact Colin Poitras at .
