http://www.pittsburghlive.com/x/trib.../s_571906.html Criminal charges will be filed against a foster mother who was caring for a 2-year-old Washington Township boy who drowned after wandering away from a church function in Fayette County, District Attorney Nancy Vernon said Monday. Vernon said she will pursue charges of child endangerment and reckless endangerment of another person in the drowning of 2-year-old Donovan Barksdale, who ended up in a neighbor's pool Sunday afternoon during a cookout held by the First Christian Church in Wickhaven in Perry Township. Vernon identified the foster mother as Jacalyn Mills, a mother of five and a grandmother of 20 who has served as a foster parent in the past. Charges will be filed at a later date before Dunbar District Judge Dwight Shaner, according to Trooper Craig M. Yauch of state police at Uniontown. Barksdale died Sunday at 2:22 p.m. in the emergency room of Monongahela Valley Hospital. Washington County Coroner Tim Warco said the child is believed to have drowned in the pool. The manner of death is pending the results of an autopsy, according to Yauch. Vernon said the toddler was one of two foster children who were in Mills' care because the parents' rights had been terminated. The other child has been removed from the foster mother's care, she said. "A 9-year-old was allegedly watching the 2-year-old. When the adults went to eat, a query was made. The 9-year-old forgot that he was watching the child," Vernon said. "It's tragic. I'm sure that Jacalyn Mills is extremely upset. But then again, 2-year-olds do have a tendency to wander, and it's up to the adults to watch and protect them," Vernon said. A woman who answered the phone at Mills' residence last evening declined an interview. Vernon said the boy walked unnoticed for about 310 feet to the pool. It sits in the backyard of a home owned by Brett A. Dolfi, according to Fayette property records. The family was not home at the time of the drowning. A.J. Boni, Perry Township supervisor, said swimming pools fall under the jurisdiction of the county and the Uniform Construction Code. The code requires fences for in-ground pools and above-ground pools that are more than 4 feet deep. A removable ladder or one that lifts and locks is needed on above-ground pools that are 2 to 4 feet in depth, according to the code. A check of permits -- issued after the UCC went into effect in 2004 -- found none for the pool's owner. But pools that were installed before 2004 did not require a permit under the code, according to county planning office personnel. Donovan Barksdale and his siblings have been in foster care under the auspices of the Westmoreland County Children's Bureau for at least 18 months, according to Westmoreland court records. Barksdale's two siblings remain in foster care and are living with a family in the Rostraver area. Westmoreland Children's Bureau Executive Director Shara Saveikis declined to discuss the case, citing confidentiality concerns. The children's biological mother, Donna Barksdale, 22, of New Kensington, claimed the children's father had threatened her with violence in January 2007, according to a protection from abuse, or PFA, petition filed in Westmoreland County. Barksdale made those allegations to a caseworker during an in-home visit a week earlier. Donovan Barksdale was 8 months old. He and his 3-year-old brother and 1-year-old sister already were living in foster care at that time, according to court records. The children's biological father, Ray Russell Jr., 37, of New Kensington did not challenge the PFA order. The case was dropped three months later when neither parent appeared in court for a hearing. Russell, an inmate at Westmoreland County Prison, was convicted in April of aggravated assault for hitting a girlfriend. He is awaiting sentencing for that offense.
