Woman gets 10 years' probation in death of 4-month-old foster son

FLICK Tucson Citizen http://www.tucsoncitizen.com/daily/local/56520.php A Tucson woman was ordered to spend 10 years on probation after being convicted of reckless child abuse after the death of her 4-month-old foster son. Pima County Superior Court Judge Frank Dawley on Monday ordered probation for Guadalupe Yolanda Gomez, 48, after a jury convicted her in May. Deputy County Attorney Nicol Green asked Dawley to impose prison or a lifetime on probation. "Dwight Hill didn't deserve to die," Green said. Green asked that if Dawley imposed probation, he should order Gomez not to supervise children. Defense attorney Steven West asked for a three-year probation term, reminding Dawley that the jury didn't convict Gomez of the baby's death. "Miss Gomez does feel responsible for Dwight Hill's death," West said. The infant died Nov. 16, 2005, 11 days after Gomez was given custody, from bleeding in the brain after a skull fracture caused by blunt force trauma. West asked Dawley to allow Gomez to have contact with her son, who had been under the care of Child Protective Services. "I just want to say I'm sorry for this horrible, tragic thing that happened to baby Dwight," Gomez said, crying. Dawley noted that he was there to sentence Gomez for reckless abuse, not murder. "The unanswered question being how did Dwight's skull become fractured?" Dawley said. While on probation, Dawley said, Gomez could regain custody of her son, causing Gomez to sob and her family to react with joy. His age was not immediately available. Green noted later that CPS may ask to sever Gomez's parental rights, in which case Juvenile Court will decide whether she keeps custody. Dawley said Gomez cannot be employed in child care and the probation department must have written permission in advance if relatives or friends allow her to supervise their children alone. Gomez had originally also been indicted on a first-degree murder charge. On the eve of the trial, the prosecution asked the judge to dismiss that charge without prejudice - meaning it could be refiled. Because of a ruling during the trial, refiling the charge would amount to double jeopardy, the defense argued after the abuse verdict. Green told Dawley that prosecutors agreed with West's argument and Dawley dismissed the murder charge permanently. [[10 years' probation? CPS perpetrates more abuse, neglect, and sexual abuse and kills more children then parents in the United States. If the citizens of this country hold CPS to the same standards that they hold parents too. No judge should ever put another child in the hands of ANY government agency because CPS nationwide is guilty of more harm and death than any human being combined. CPS nationwide is guilty of more human rights violations and deaths of children then the homes from which they were removed. When are the judges going to wake up and see that they are sending children to their death and a life of abuse when children are removed from safe homes based on the mere opinion of a bunch of social workers.
