Media goes to court to get full disclosure from CPS

More information will soon be released on the three murdered Tucson
children with ties to Child Protective Services.

Back in February, police found the body of 4 year old Ariana Payne
hidden in a plastic container at a midtown storage facility.

Investigators searched a local landfill for her 5 year old brother
Tyler, but found nothing.

Then, in March, 5 year old Brandon Williams died from blunt force trauma
to the head.

Just last week, News 4 received a summary of CPS involvement with the
children before their deaths, but not full disclosure of the CPS files.

Monday, in Phoenix, a judge heard the media's case.

"We're not here," began Kevin Wein, an attorney representing the Arizona
Daily Star, "to beat up on CPS or to point fingers and indicate that
they failed and, as a result, three children are dead. I think we all
realize, in many ways, that CPS has an almost impossible job here."

Nearly four months after News 4 requested the CPS files on Ariana and
Tyler Payne and Brandon Williams, the Arizona Daily Star and the Arizona
Republic newspapers gathered in court to argue the case for disclosure.

The Pima County Attorney's Office has decided, releasing the files won't
hurt the criminal cases against the children's alleged killers:
Christopher Payne and his live-in girlfriend, Reina Gonzales, and
Brandon Williams' mother, Diane Marsh, and her friend, Flower Tompson.
The judge will, now, decide what to release.

Gaylene Morgan is with the Attorney General's office. "There are about
55 participants in the Payne case; different people who've participated
in the Payne case. Some [are] entitled to confidentiality. Some, maybe
not. And then, about 75 in the Williams' [case]."

"This is the agency charged with protecting their safety and here these
children are dead," continued attorney Kevin Wein. "I think it's in the
public's interest to find out what happened."

Bottom line: When News 4 asked the state whether the eventual release of
the documents would highlight problems within CPS, Ken Diebert, the
Deputy Director of the Department of Economic Security which oversees
CPS, said yes, it probably will. But he's looking forward to that
information coming out.

"There are areas we are constantly looking at through our ongoing
quality assurance process that we're trying to address today."

The state turned over its files Monday which the judge will now go
through and figure out what to release.
