Former CPS counselor Preston Carbary is on trial for the alleged rape of
one of his former patients.


CPS counselor on trial over rape allegations

COLVILLE -- A trial is underway in Stevens County for a former CPS
mental health counselor facing three counts of rape stemming from
accusations raised in the fall of 2004 by one of his former clients.

Preston Carbary allegedly raped the victim in her home three times in
November of 2004. At the time Carbary was a mental health counselor for
Child Protective Services and had been providing counseling for the
victim and her family in Colville.

The victim said Carbary took advantage of her knowing her troubled past.
She said her mother had prostituted her since she was eight-years-old to
make money. So when Carbary told her, “Just go along with it, do what
you're told everything will be all right", she says she cooperated.

But everything wasn't alright. She became suicidal and eventually
confessed to her family doctor of 16 years what happened.

Defense attorney Tim Trageser questioned the victim's credibility,
arguing that she has a long mental history and had been on various
medications including prescribed marijuana. The defense also suggested
the rape allegations are motivated by greed and money and grilled the
victim regarding a civil suit seeking $3 Million in damages.

At one point during the trial Tuesday a juror realized he knew the
plaintiff. That juror was dismissed and an alternate juror took their
place. Later this week another woman who alleges Carbary raped her while
providing counseling services is expected to testify.

Meanwhile, since the accusations came out in 2004 Preston Carbary's
license has been suspended in Washington and Idaho.

The trial resumes Wednesday.

The jury reached the verdict late Wednesday night after several hours of
deliberations in the case that involved allegations from the fall of
2004 that Carbary, who was a mental health counselor for CPS, had raped
the victim in her home on three separate occasions in November of 2004.

At the time he had been providing counseling services to the victim and
her family in Colville.

The trial began on Tuesday and went to the jury Wednesday afternoon.

And by not noticing it was a "he said she said" charge, with NO
physical or witness evidence, and based soley on the accusation of a
