back child support after death of child????
Ok, so this is coming out of left field, but please answer. My ex wife had
a baby 2-1/2 years ago from some other guy. He never paid any CS, tho she did file and try to get some. He is hiding from CS folks, go figure. So she felt life was too hard, killed herself and her son this week, and left my two boys halfway across the country without a mother. My oldest is 20, other is 14. They are the sole heirs. Is the back support he owes considered part of the estate? Is there any chance of them ever receiving any of it? Any ideas? Thanks folks, she was dirt poor and the costs of this are way more than my son can deal with. Any little help or inheritance would be great for him. My youngest of course will have SSI benifits being a minor, but the older one is just holding the bag, cleaning up after mom. Thanks Jon |

It's such a shame that CPs like your ex, NCPs, or anyone who isn't equipped to handle stress don't get help before they take such extreme steps. My oldest is 20, other is 14. Unfortunately I believe most CS and SS orders are written in such a manner that in the event of death of their receipient, or the child in a CS order, the obligation is lifted. I've never heard of case where a third party has collected on arreages on CS after death of the reciepient and child. I know there have been cases where third parties ( ie children of the deceased) have tried to collect arrearages of SS on behalf of their parent's estate and they have been denied each and every time. Unless I have been completely fooled, this Jon is the same Jon who has testified before the Oregon House Judiciary Committee on the same proposed legislative bills I testified about. I can't vouch for his story, but I do know he is active concerning CS issues, has custody of two children, and I tend to believe him about the ex's suicide since the facts fit what I know about him. |
