CPS Accused of Negligence in Foster Child's Death

The family of a child who died Monday in the care of a foster mother is
claiming negligence in a wrongful death claim being filed against
Sacramento County's Child Protective Services.

That claim is in the death of 18-month-old Tamaihia Moore, found dead in
her bed Monday morning. Sacramento police have now arrested the foster
mother, 34-year-old Tamekca Walker, on charges of murder and felony
child abuse.

The claim filing comes on the same day Walker is set for arraignment.
Under law, a claim must be filed and the county must accept, respond, or
reject the claim before a civil suit can be filed.

The child's biological father Calvin Moore, grandmother Debra Oliver,
and aunt Patrice Moore, allege CPS workers ignored their reports of the
child appearing malnourished, dehydrated and possibly abused during
visitations after the child was placed in Walker's home September 19,
according to their attorney Bruce Fagel.

The claim says Oliver and Patrice Moore twice informed CPS workers of
their fears, once after a visitation October 7, the second time this
past Saturday, October 20. In the second instance, the grandmother and
aunt say they begged the case worker to take the child to a hospital.
Instead, it appears she was returned to Walker's South Sacramento foster
home.

A CPS spokeswoman said the agency cannot comment on pending litigation.

While police won't detail a suspected cause of death or the extent of
the child's injuries, they say they're confident the death was caused by
child abuse. Walker is single and is the only adult living in the home.

Besides Tamaihia Moore, Walker was also caring for two other foster
children, a 2-year-old girl and a 3-month-old girl. She also ran a
licensed daycare in her home.

Walker's parents told News10 their daughter would never "raise a hand to
a child." They said the child was hard to handle, often injuring herself
from falls and disrupting the other children.

Five days before the child's death, Tamekca Walker asked CPS to have the
child removed from her care but was told they wanted to keep her there,
according to Willie and Cathy Walker.

While CPS director Laura Coulthard won't address the case specifically,
citing confidentiality laws, she said earlier that any allegation of a
child in danger is taken seriously.

"If it was an allegation that the child was unsafe, we would need to be
out there immediately. If it's an allegation that sounds like it could
wait a day or two that may be the way that it's handled," she said.

According to the child's family members, the child was placed in foster
care because the mother is incarcerated and the father lost custody.

Imagine that, 6.4 children die at the hands of the very agencies that
are supposed to protect them and only 1.5 at the hands of parents per
100,000 children. CPS perpetrates more abuse, neglect, and sexual abuse
and kills more children then parents in the United States. If the
citizens of this country hold CPS to the same standards that they hold
parents too. No judge should ever put another child in the hands of ANY
government agency because CPS nationwide is guilty of more harm and
death than any human being combined. CPS nationwide is guilty of more
human rights violations and deaths of children then the homes from which
they were removed. When are the judges going to wake up and see that
they are sending children to their death and a life of abuse when
children are removed from safe homes based on the mere opinion of a
bunch of social workers.
