Justice Joyce Kennard, the sole dissenter, said Bruiniers "never
mentioned the potential harm to the children from losing their mother
as their primary caretaker, despite undisputed evidence that this harm
would be significant."


Justice Kennard is conveniently ignoring the fact that the mother is
*choosing* to leave.

The kids have a family. A mother and a father. That should not even
be allowed to be broken any more than divorce already does that, when
any or either of the parents wants to maintain their relationships with
their kids. One parent gets married and wants to move? Tough. They
have a choice to make.

Dave I too think this is a good thing. However they didn't go far enough. They
should also prohibit NCPs from moving away from their children.

I agree. Fair is fair. While I don't think the government should
mandate where a person lives literally, I do say that if a parent (CP
or NCP) *chooses* to move, they then give up all expectations of
custody and/or visitation, and they go alone. Or, with their new and
wonderful spouse, as the case may be.

Your bias is showing...they didn't prohibit the CP from moving away from
the children.

I'm curios - why is it more important to force the NCP to remain where
the children are? Is this your admission that fathers are more
important to kids than mothers are?
