Innocent boy needs help
Derek and Alex King are innocent. The evidence proves their innocence.
Their own jury believed they did not kill their father. Now the younger boy, Alex, jailed since he was 12, may go to adult prison, where he will most certainly die. At 16, boys can be sent to adult prison in Florida. King, 15, is being held at the Okeechobee Juvenile Offender Corrections Center, a high-risk facility in South Florida for young male inmates. He and another young man were arrested on the morning of March 5, after corrections officers allege the pair attempted an overnight escape through a ceiling. The State Attorney's Office in Pensacola was informed of the escape charge against King this week. In a sensational, nationally publicized case, King and his brother, Derek, now 16, in November 2002 pleaded guilty to third-degree murder in the killing of their father, Terry King, at their Cantonment home. Derek King confessed to hitting his father in the head with an aluminum baseball bat. Alex King told authorities the killing was his idea. The pair then set fire to the home and fled. Sgt. Billy Markham, an Okeechobee County Sheriff's Office spokesman, said Alex King and inmate Justin Huggins, 18, climbed up into the ceiling of a classroom and attempted to find a way out to the roof. "They didn't get very far," he said. The boys allegedly sneaked into the classroom while corrections officers made evening rounds, checking inmates' cells. The pair "made their beds with blankets under the covers to make it appear that they were actually in bed," according to King's arrest report. Officers found the boys in the classroom the following morning. The boys told the officers another officer had "let them out" of their cells the night before, and "they were on the telephone all night." The State Attorney's Office in Florida's 19th Judicial Circuit is prosecuting King as an adult, raising the possibility that he could be sent to an adult prison if convicted of escape. The Florida Department of Corrections elected to place both King boys in juvenile facilities for the murder of their father. King, who would be eligible for release on the murder charge in 2008, will appear in court on the escape charge in May. Escape, even if unsuccessful, is punishable by up to 15 years in prison. The sentence must be served consecutive to the sentence that the inmate already is serving. ??The Pensacola News Journal April 29, 2005 ------------------------ I've been talking to a reporter. I've been trying to convince him to write a story about Alex and the alleged escape attempt. He is collecting information. The more publicity this gets, the better. This case makes prosecutor David Rimmer and the whole system look terrible. They don't like bad publicity. What they really want is as few news stories as possible. What will help Alex the most is the glare of news stories. Travesties of justice should be exposed to the light of day. After all, if it wasn't for all the publicity, Judge Bell wouldn't have thrown out the jury's 2nd degree murder conviction. It's best to yell and scream and get news attention on this. David Rimmer doesn't want publicity on this. The glare of publicity will put pressure for a just resolution of this charge. The charge should be dismissed. I know nothing about this case, but this seems a bit of a contradiction to me.... Have the boys recanted their guilt? |

Then, IIRC, they then recanted, blaming the murder on a neighbor whom the younger boy (aged 12 at the time) claimed he was having an affair. The neighbor denied all involvement. The prosecutors proceeded on separate tracks, prosecuting the Kings and the neighbor. The neighbor was acquitted, and the Kings were both convicted of second degree murder. The Court threw out the conviction, although I don't recall why; I believe it was procedural. Thereafter,the Kings pled guilty to third degree murder (the older boy admitting that he killed his father by hitting him in the head with a baseball bat, then torched the home to hide evidence; and the younger boy admitting that the whole thing was his idea) in return for reduced sentences to be served in juvenile facilities. The interesting thing about this case was the age of the boys (12 and 13 at the time that they killed their father), and the issues that it raised as to trying and punishing adolescents as if they were adults. I certainly don't have any answers there. My liberal side recognizes that these boys are still children; I cannot accept that they are irredeemable. OTOH, even a 12 year old is old enough to understand that it is wrong to bash someone in the head with a baseball bat until his head caves in. But I think even a 40 year old is not "old enough" to really understand right and wrong if they were not there in his or her formative years. This is one reason why the Supreme Court made it unconstitutional to put someone to death for a crime committed before that person turns 18.
