Saratoga County’s Child Protective Services Abuses Another Family.

http://mohawkvalley.wordpress.com/20...nother-family/

Note: The tragic events recorded in the article below are becoming the
rule rather than the exception. Similar incidents have been written
about in the past year in The Smithsonian Magazine, Reader’s Digest,
Woman’s Day and many other magazines and newspapers. CPS is out of
control and CPS investigators and the doctors, psychologists and social
workers that work with them are fast becoming the number one child
abusers in America. They destroy more children and families than they help.

Julia “has loving parents who attempted to get her the absolute
best medical care that they could, and as a result, Child Protective
Services intervened in their lives and ripped their child from their
home,” [Laurie] Shanks said.

ALBANY– A baby girl who suffered mysterious bruises and broken bones
will be returned to her Saratoga County parents, a state appeals court
ruled.

In 2004, Saratoga County Family Court found “Julia BB’s” parents guilty
of child abuse and removed the 5-month-old girl from the family’s home.
But the Appellate Division of state Supreme Court overturned the ruling
on Thursday, saying the two doctors who testified against the parents
wrongly attributed the girl’s injuries to child abuse.

“There was a rush to judgment on both the part of the Department of
Social Services and the doctors,” said Laurie Shanks, an Albany Law
School professor who represented the family.

The appellate court ruling said one doctor was inexperienced and the
other was on a personal crusade.

The appellate court cited testimony from a court-appointed psychologist
who said Julia’s parents were warm and nurturing and “would be very good
instructors in a parenting class.”

The court withheld the last name of the family to protect the identity
of the child.

Julia’s story began in November 2003, just weeks after her birth. Her
mother took her to the family pediatrician with purple marks on her
back, chest and leg. The bruises came and went, and the pediatrician,
Dr. Sushil Sood, testified that they did not progress from black to blue
to green to yellow, but rather, appeared as small blue dots that would
disappear in a day or so. Julia showed no signs of pain.

From there, a chain of events begins that lead to Julia’s removal:

Julia’s family brings her to the doctor repeatedly with signs of bruising.

A full-body skeletal X-ray shows a skull fracture and fractured ribs,
left forearm and left tibia.

Tests for osteogenesis imperfecta, better known as brittle bone disease,
are negative.

Child Protective Services begins an investigation.

Dr. James Slavin, an orthopedic surgeon, examines Julia and deems her
injuries are the result of child abuse.

Julia’s grandmother moves in to help care for the girl and her two older
siblings and tells the court that the parents carried the baby on a
pillow to protect her.

Emergency medical technicians respond to a 911 call at Julia’s home and
find Julia spitting up mucus. Dr. Javier Sanchez of Albany Medical
Center concludes it was a “smothering incident.”

Saratoga Family Court Judge Gilbert Abramson rules that the parents
severely abused Julia and neglected the two older children. Julia is
removed from the family’s home March 2003.

The appellate court on Thursday ruled there was no evidence that Julia’s
two older siblings were abused, and that the Family Court abused its
discretion by denying the motion to reopen the case to hear testimony
from two additional medical experts.

Subsequent testimony of new doctors said Julia suffered from a variant
of the brittle bone disease that cannot be tested for. The doctors also
stated that Julia’s parents repeatedly sought medical help for Julia and
consistently took her to the same doctor, which is not the behavior of
parents trying to hide abuse.

The appellate court said Sanchez’ lack of experience and Slavin’s
“transition from the role of physician to advocate and his resulting
crusade … all but eviscerates the value of their medical testimony.”

Shanks, the family’s lawyer, said Julia’s mother teaches at a college
and her father is a business executive. Shanks said they have spent all
their money trying to get Julia back.

Julia “has loving parents who attempted to get her the absolute best
medical care that they could, and as a result, Child Protective Services
intervened in their lives and ripped their child from their home,”
Shanks said.

Julia, now 3 years old, will soon be returned to her parents.

Default Dan Sullivan, called System Suck by Greg et al ... Saratoga County's Child Protective Services Abuses Another Family.

fx, this is very important information to relay. Though two posters in
this newsgroup, between them, researched this relatively unknown (at
the time) premmie brittle bone disease, (Dan) and the other mailed a
notice to all CPS and state's attorney's general about this it appears
that at the time of this article being printed at least one state did
not recognize the need to read and understand what they had
received....or someone round-filed my post.

And my posts were sent by registered letter, not e-mail.

Do you find it odd that given the work of both Dan (he's the real hero
of this story...because he used the information he researched to help
overturn a removal and get Loyal Fan's precious daughter returned to
the family) and myself, that Greg would persistently refer to us as
System Sucks, and pretend we don't help families that come here for
support?

Do speak to him about this. I can't speak for Dan, but for myself, it
really hurts my feelings.

A bit of history. In Nov of 2003 Dan produced a link to some research
he found that showed a NEW and only recently explored variant of OI
that was seen mostly in children who were born prematurely.

http://groups.google.com/group/alt.s...7cd3faff28609b

http://tinyurl.com/26hvp9

And he posted the report on it. I made it my task to inform all state
governments of it. Not JUST CPS but the state's attorney's general as
well...since this is a legal issue for families and the state.

Do you think Dan and I were system sucky enough? 0:]

You might wonder what prompted this post.

Well, it has to do with letting the silly ****s here, you included,
dig yourself a deep enough hole.

I decided long ago to let the "System Suck" lie play itself out, and
now, little ****ant, and Greg your littler brother, the chicken's, as
they say, are coming home to roost.

Stay tuned.

Happy days, for it won't be long now.

Court has girl returned to parents

Child abuse claims were baseless, justices rule in Saratoga County case

ALBANY- A baby girl who suffered mysterious bruises and broken bones
will be returned to her Saratoga County parents, a state appeals court
ruled.

In 2004, Saratoga County Family Court found "Julia BB's" parents guilty
of child abuse and removed the 5-month-old girl from the family's home.
But the Appellate Division of state Supreme Court overturned the ruling
on Thursday, saying the two doctors who testified against the parents
wrongly attributed the girl's injuries to child abuse.

"There was a rush to judgment on both the part of the Department of
Social Services and the doctors," said Laurie Shanks, an Albany Law
School professor who represented the family.

The appellate court ruling said one doctor was inexperienced and the
other was on a personal crusade.

The appellate court cited testimony from a court-appointed psychologist
who said Julia's parents were warm and nurturing and "would be very good
instructors in a parenting class."

The court withheld the last name of the family to protect the identity
of the child.

Julia's story began in November 2003, just weeks after her birth. Her
mother took her to the family pediatrician with purple marks on her
back, chest and leg. The bruises came and went, and the pediatrician,
Dr. Sushil Sood, testified that they did not progress from black to blue
to green to yellow, but rather, appeared as small blue dots that would
disappear in a day or so. Julia showed no signs of pain.

From there, a chain of events begins that lead to Julia's removal:

Julia's family brings her to the doctor repeatedly with signs of bruising.

Julia's grandmother moves in to help care for the girl and her two older
siblings and tells the court that the parents carried the baby on a
pillow to protect her.

Emergency medical technicians respond to a 911 call at Julia's home and
find Julia spitting up mucus. Dr. Javier Sanchez of Albany Medical
Center concludes it was a "smothering incident."

Saratoga Family Court Judge Gilbert Abramson rules that the parents
severely abused Julia and neglected the two older children. Julia is
removed from the family's home March 2003.

The appellate court on Thursday ruled there was no evidence that Julia's
two older siblings were abused, and that the Family Court abused its
discretion by denying the motion to reopen the case to hear testimony
from two additional medical experts.

Subsequent testimony of new doctors said Julia suffered from a variant
of the brittle bone disease that cannot be tested for. The doctors also
stated that Julia's parents repeatedly sought medical help for Julia and
consistently took her to the same doctor, which is not the behavior of
parents trying to hide abuse.

The appellate court said Sanchez' lack of experience and Slavin's
"transition from the role of physician to advocate and his resulting
crusade ... all but eviscerates the value of their medical testimony."

Shanks, the family's lawyer, said Julia's mother teaches at a college
and her father is a business executive. Shanks said they have spent all
their money trying to get Julia back.

Julia "has loving parents who attempted to get her the absolute best
medical care that they could, and as a result, Child Protective Services
intervened in their lives and ripped their child from their home,"
Shanks said.

Julia, now 3 years old, will soon be returned to her parents.

Julia's grandmother moves in to help care for the girl and her two older
siblings and tells the court that the parents carried the baby on a
pillow to protect her.

Dan didn't. I did.

Proof? Let me check. Yep, there it is right there in my old word
processing documents folder...the final draft of the letter I gave to
my secretary and she spent a full day printing out from my disk, with
a nice merge file she had of all the CPS and AGs offices in the
nation. Then addressing the envelopes, then stuffing, and running them
through the postage meter.

In fact, she even carried them to the mail box that very day when she
went for the office mail.

She didn't seem to mind at all, after reading the content as she
proofed it for me.

Greg, I have the same amount of proof you do that you weren't really
ogling for excitement when you used that cold shower aversive therapy
and claimed it worked.

Either you lied about sending the info to them, or
your name must not carry much weight with them.

Odd you'd say that. I felt the same way myself, until I got 42
responses. Each from a separate state.

As for weight, well you know bureaucracies. I don't let their busy
load of tasks come after me Greg.

Oh, you mean the rash of such cases since....I see.

How many 0:] have there been?

You can list them right here for us, of course, when you answer.

Either way it's embarassing for you.

Embarrassing? I wasn't looking for comfort, just helping families and
children.

Who did you inform, officials and authority wise, about the material
Dan made available to us.

Would you list those for us? I want to see if there was any overlap.

I sent 52 letters. PR, and our Pacific Protectorate.

Just THINK of all the settlement money you could
have saved their malpractice insurer.

Who?

Oh, the case below.

Well, I don't know about that.

I don't control how a state handles information, but you will note
that in all these years we are looking at only ONE such case going
bad.

Of course the others, which I'd hardly think don't exist, given the
extreme nature of the symptoms haven't shown up here. And Dan's
conversation with Steve, where he kind of waxed Steve's butt for
playing down the actual number based on available data, would suggest
more than enough per year for CPS to be involved, and catch what they
saw as non-abuse and either not open, or simply close a case after a
bit of investigation and who knows, maybe contact with the researcher.

You didn't read the thread I linked to did you?

Dan had TWO such case in a fairly short period of time. That's kind of
remarkable, given Steve's claim of 'rarity.' (It's not all that rare).

And my posts were sent by registered letter, not e-mail.

Yeah Yeah, the check is in the mail.

Your disbelief is charming. You have such a loser attitude, and such
poor follow through yourself you project it on to others.

Doubtless Dan wins for the families because he does not sit there
whining, but actually DOES something to help with facts in the case as
presented to him.

Chuck wasn't anonymous. Just used a name to indicate his feeling about

Not to mention the malpractice insurer for the state!

Once the letters were in the mail I had no control over who saw them.
Nor did I know the names of the various insurers.

What was done with the information, and my very short cover letter,
was not in my control.

So, how any more of these cases have you been seeing, where the state
failed to recognize the less common form of OI in preemies?

Actually, I don't know this little girl WAS a preemie, so if not, I
can certainly see why the docs and CPS were thrown off.

One has to go with the information one has, no?

As I recall the info on the material Dan located and I sent, this rare
form of OI was strictly limited to preemies.

NO mention of the child being a preemie was included in this article.

You have either the laziest mind in this group...and that's saying a
lot considering your poor limited friend, Dennis, or you lie, OR, more
likely, you have a psychological conditioning that controls how and
what you see even when you look right at it and the facts reveal
something quite different from your perceptions.

There's a name for it, but it escapes me right now. 0:]

Clearly you were not listened to,

Really? Our info was on preemies. This child was apparently not one.
Fooled the docs. See the words in the article, Greg. Read the words in

Now why would they even think of the info I sent? The doctors didn't
have it, most likely...and it's confined to PREEMIES.

You know this from one case? Wow, you are wise, Greg the Magnificent.

Nah.

Incongruent with your actual posted responses.

Well, it has to do with letting the silly ****s here, you included,
dig yourself a deep enough hole.

So far it looks like you proved what many Family Rights
people have been telling you all along about the arrogance
of the agency staff, from top to bottom.

Well, they are wrong then. Mistakes, oversights, failure to transmit
information, forgetting information, high turnover rates from lack of
adequate pay, high caseload fatigue, and dealing with unwarranted
distracting attack from little cowardly ****ants that stand around
outside and glower, is almost certain to cause system failure.

I've seen a lot of goofs in CPS, some because of plain old individual
incompetence, and I've seen many more from that old classic, system
failure, brought on by my laundry list above.

My first day in a CPS office as a student, and having seen a tad bit
of combat fatigue before, I noted that most workers had the symptoms.

And they didn't when they were new.

I decided long ago to let the "System Suck" lie play itself out, and
now, little ****ant, and Greg your littler brother, the chicken's, as
they say, are coming home to roost.

I doubt it Donald.

Keep doubting, and I'll get word to him.

Your arrogance, along with some other fine attributes are what we are

Stay tuned.

From there, a chain of events begins that lead to Julia's removal:

Julia's family brings her to the doctor repeatedly with signs of bruising.

Imagine that, 6.4 children die at the hands of the very agencies that
are supposed to protect them and only 1.5 at the hands of parents per
100,000 children. CPS perpetrates more abuse, neglect, and sexual abuse
and kills more children then parents in the United States. If the
citizens of this country hold CPS to the same standards that they hold
parents too. No judge should ever put another child in the hands of ANY
government agency because CPS nationwide is guilty of more harm and
death than any human being combined. CPS nationwide is guilty of more
human rights violations and deaths of children then the homes from which
they were removed. When are the judges going to wake up and see that
they are sending children to their death and a life of abuse when
children are removed from safe homes based on the mere opinion of a
bunch of social workers.

Stay tuned.

Default Greg? Saratoga County's Child Protective Services Abuses AnotherFamily.

So you are going to ignore your claim that Loyal Fan was just a code
name sock, and not Chuck Kimmel who Dan helped recover his OI injured
child from CPS?

You know, Greg, when you don't own up to your mistakes such as this it
may make YOU feel like you are a wonderful debater, clever, too sneaky
by half, but it shows clearly what a lowlife scumsucking little lying
prick you are...with zero credibility.

And of course shows others Dan's credibility is rock solid. Did you mean
to do that, asshole?

Oh, Dan, lay it on me. 0:]

(but I did it for Chuck. He is a person. He regained his child, and the
child and parent hating prick that claims he's a family rights advocate
is being treated too kindly by my naming him what he is.)
