DCF Agrees To Settle Lawsuit
Bulk Of $10 Million To Help Mentally Ill

The state Department of Children and Families has agreed to spend $10
million over the next three years to improve services for mentally ill
children in foster care in order to settle a federal class action lawsuit.

The terms of the settlement were finalized on the final day of the state
legislative session Wednesday. The money for the expanded services is
expected to be included in the new two-year state spending plan
currently under negotiation at the Capitol.


As part of the settlement, DCF agreed to spend $3 million to improve
emergency mobile psychiatric services to help children in crisis before
they wind up in crowded hospital emergency rooms. Another $5.3 million
is earmarked for more comprehensive, community-based mental health services.

The remaining $1.7 million would cover the costs of a consultant to
oversee implementation of the settlement at an annual salary of up to
$175,000 a year, the plaintiffs' legal costs and other ancillary services.

The department also agreed to complete 43 new special therapeutic group
homes to serve 173 mentally ill youth currently languishing in costly
institutional care or foster homes.

"It is critically important for youth with mental health issues to learn
how to live in the community, rather than be warehoused in
institutions," said attorney Anne Louise Blanchard of Connecticut Legal
Services Inc. Blanchard served as the lead attorney in the case,
representing a class of approximately 2,000 mentally ill youth in need
of better care.

"This settlement will facilitate DCF's ability to meet these youths'
needs, reduce the amount of failed placements they experience, and, most
importantly, assist them in becoming successful after they leave state
care," Blanchard said.

The lawsuit was filed in March 2002. One of the original plaintiffs, a
girl known as Susan K., had been placed in more than 46 different foster
homes, hospitals, shelters and other institutions while in DCF care.

She never had a chance to learn how to live in the community, to attend
her local school or hold a job, Blanchard said. Susan K. is now
receiving services to help her with her rent, education and job
training, and is successfully living on her own and working part time.

Under state and federal law, DCF is required to provide a full range of
services for children in its care, Blanchard said. Those placed in
foster homes or long-term institutions have not had their therapeutic
needs met. Released into the community when they turn 18, many are
unable to care for themselves and wind up in hospitals, prisons and
shelters, Blanchard and other advocates said.

Brian Mattiello, chief of staff for DCF Commissioner-nominee Susan
Hamilton, said many of the improvements outlined in the settlement are
already taking place as part of the agency's initiatives to improve
children's access to mental health care.

"Many of these initiatives we already have in place," Mattiello said.
"They are very consistent with what we are doing."

and Kane blames that on FUNDING?

The states already get huge funding through Medicaid
for almost every kid in the system.

Visit supervision is paid for with this.
Nevermind that the contract Social Worker is not actually a licensed
Social Worker.

""Therapy"" is similarly paid for this way, through
people who are not actually licensed therapists.

Hasn't this huge FUNDING arrangement been in place for over 30 years?

I've discussed the very thing, and why it happens, in ascps, Greg, and
I believe it was with you.

And still you presume, as the ignorant will, that CPS has sole control
over when a child is moved.


Dependancy court exists to serve CPS.

Just a short list from my longer one some years back:

A judge can order a move to accommodate the bio parents transportation
issues.

A child can run away, and the foster family not want the child to
return.

A foster family can ask for a removal for a number of very valid
reasons.
...they child isn't manageable by them
...the child presents a risk to others, or another child in the home
presents a risk to the child they wish moved
...a judge orders the child back to the parents, the reunification
fails and the child is again placed out of home...there is even USDHHS
data on this one
...the child makes an abuse allegation against the foster parents (it
doesn't even have to be true...they will be taken out of the home if
the allegation is credible).
...the child is placed in a treatment or rehabilitation setting for a
period of time (Yes, it is a move and must be counted as such)
...the original placement was temporary while preparing to place the
child with a foster family more suitable (they are full, but a child
is leaving in a few weeks, or less)

I just told you they do not have to be, though on occasion actual
caseworkers DO visitation supervision to do observations.

Common run of the mill visitations are done by social service aides.

And they do not claim they are social workers.

I didn't say there was NO incorrect billing. I said what the law says
in most states.

You cannot bill medicaid if you do not have, as a therapist, the
proper credentials. For counseling, it must be a master's or higher.

My solution is to properly fund for those services, and I am agreed
with by experts in the field.

You cannot get high quality practice from low paid poorly educated
professionals.

The state gets what they pay for. In fact, often they get better than
they pay for.

institutions," said attorney Anne Louise Blanchard of Connecticut Legal
Services Inc. Blanchard served as the lead attorney in the case,
representing a class of approximately 2,000 mentally ill youth in need
of better care.


"This settlement will facilitate DCF's ability to meet these youths'
needs, reduce the amount of failed placements they experience, and, most
importantly, assist them in becoming successful after they leave state
care," Blanchard said.


The lawsuit was filed in March 2002. One of the original plaintiffs, a
girl known as Susan K., had been placed in more than 46 different foster
homes, hospitals, shelters and other institutions while in DCF care.


She never had a chance to learn how to live in the community, to attend
her local school or hold a job, Blanchard said. Susan K. is now
receiving services to help her with her rent, education and job
training, and is successfully living on her own and working part time.


Under state and federal law, DCF is required to provide a full range of
services for children in its care, Blanchard said. Those placed in
foster homes or long-term institutions have not had their therapeutic
needs met. Released into the community when they turn 18, many are
unable to care for themselves and wind up in hospitals, prisons and
shelters, Blanchard and other advocates said.


Brian Mattiello, chief of staff for DCF Commissioner-nominee Susan
Hamilton, said many of the improvements outlined in the settlement are
already taking place as part of the agency's initiatives to improve
children's access to mental health care.


"Many of these initiatives we already have in place," Mattiello said.
"They are very consistent with what we are doing."
