In 2004, Saratoga County Family Court found “Julia BB’s” parents guilty of child abuse and removed the 5-month-old girl from the family’s home. But the Appellate Division of state Supreme Court overturned the ruling on Thursday, saying the two doctors who testified against the parents wrongly attributed the girl’s injuries to child abuse. “There was a rush to judgment on both the part of the Department of Social Services and the doctors,” said Laurie Shanks, an Albany Law School professor who represented the family. The appellate court ruling said one doctor was inexperienced and the other was on a personal crusade. The appellate court cited testimony from a court-appointed psychologist who said Julia’s parents were warm and nurturing and “would be very good instructors in a parenting class.” The court withheld the last name of the family to protect the identity of the child. Julia’s story began in November 2003, just weeks after her birth. Her mother took her to the family pediatrician with purple marks on her back, chest and leg. Julia showed no signs of pain. From there, a chain of events begins that lead to Julia’s removal: Julia’s family brings her to the doctor repeatedly with signs of bruising. A full-body skeletal X-ray shows a skull fracture and fractured ribs, left forearm and left tibia. Tests for osteogenesis imperfecta, better known as brittle bone disease, are negative. Child Protective Services begins an investigation. Dr. James Slavin, an orthopedic surgeon, examines Julia and deems her injuries are the result of child abuse. Julia’s grandmother moves in to help care for the girl and her two older siblings and tells the court that the parents carried the baby on a pillow to protect her. Emergency medical technicians respond to a 911 call at Julia’s home and find Julia spitting up mucus. Dr. Javier Sanchez of Albany Medical Center concludes it was a “smothering incident.” Saratoga Family Court Judge Gilbert Abramson rules that the parents severely abused Julia and neglected the two older children. Julia is removed from the family’s home March 2003. The appellate court on Thursday ruled there was no evidence that Julia’s two older siblings were abused, and that the Family Court abused its discretion by denying the motion to reopen the case to hear testimony from two additional medical experts. If the citizens of this country hold CPS to the same standards that they hold parents too. this newsgroup, between them, researched this relatively unknown (at the time) premmie brittle bone disease, (Dan) and the other mailed a notice to all CPS and state's attorney's general about this it appears that at the time of this article being printed at least one state did not recognize the need to read and understand what they had received....or someone round-filed my post. And my posts were sent by registered letter, not e-mail. Do you find it odd that given the work of both Dan (he's the real hero of this story...because he used the information he researched to help overturn a removal and get Loyal Fan's precious daughter returned to the family) and myself, that Greg would persistently refer to us as System Sucks, and pretend we don't help families that come here for support? Do speak to him about this. I can't speak for Dan, but for myself, it really hurts my feelings. A bit of history. She didn't seem to mind at all, after reading the content as she proofed it for me. What was done with the information, and my very short cover letter, was not in my control. So, how any more of these cases have you been seeing, where the state failed to recognize the less common form of OI in preemies? Actually, I don't know this little girl WAS a preemie, so if not, I can certainly see why the docs and CPS were thrown off. One has to go with the information one has, no? As I recall the info on the material Dan located and I sent, this rare form of OI was strictly limited to preemies. NO mention of the child being a preemie was included in this article. First published: Friday, June 1, 2007 ALBANY- A baby girl who suffered mysterious bruises and broken bones will be returned to her Saratoga County parents, a state appeals court ruled. In 2004, Saratoga County Family Court found "Julia BB's" parents guilty of child abuse and removed the 5-month-old girl from the family's home. But the Appellate Division of state Supreme Court overturned the ruling on Thursday, saying the two doctors who testified against the parents wrongly attributed the girl's injuries to child abuse. "There was a rush to judgment on both the part of the Department of Social Services and the doctors," said Laurie Shanks, an Albany Law School professor who represented the family. The appellate court ruling said one doctor was inexperienced and the other was on a personal crusade. The appellate court cited testimony from a court-appointed psychologist who said Julia's parents were warm and nurturing and "would be very good instructors in a parenting class." The court withheld the last name of the family to protect the identity of the child. Julia's story began in November 2003, just weeks after her birth. Her mother took her to the family pediatrician with purple marks on her back, chest and leg. The bruises came and went, and the pediatrician, Dr. Sushil Sood, testified that they did not progress from black to blue to green to yellow, but rather, appeared as small blue dots that would disappear in a day or so. Julia showed no signs of pain. From there, a chain of events begins that lead to Julia's removal: Julia's family brings her to the doctor repeatedly with signs of bruising. A full-body skeletal X-ray shows a skull fracture and fractured ribs, left forearm and left tibia. Tests for osteogenesis imperfecta, better known as brittle bone disease, are negative. Child Protective Services begins an investigation. Dr. James Slavin, an orthopedic surgeon, examines Julia and deems her injuries are the result of child abuse. Julia's grandmother moves in to help care for the girl and her two older siblings and tells the court that the parents carried the baby on a pillow to protect her. Emergency medical technicians respond to a 911 call at Julia's home and find Julia spitting up mucus. Dr. Javier Sanchez of Albany Medical Center concludes it was a "smothering incident." Saratoga Family Court Judge Gilbert Abramson rules that the parents severely abused Julia and neglected the two older children. Julia is removed from the family's home March 2003. The appellate court on Thursday ruled there was no evidence that Julia's two older siblings were abused, and that the Family Court abused its discretion by denying the motion to reopen the case to hear testimony from two additional medical experts.
