GROTON, Conn. (AP) _ The state's medical examiner has ruled that a
2-year-old Groton girl's death was a homicide by drowning.

The ruling was released after an autopsy Tuesday on the body of Treau
Bemis, who was found unresponsive in a bathtub Sunday night.

State child welfare officials say the girl was living in a house with
her aunt, Kimberly Bemis, and her aunt's boyfriend, Craig Betancourt.

Betancourt, 32, has been charged with capital felony murder. Police said
Betancourt confessed to killing the toddler while baby-sitting her.

During Betancourt's arraignment in court Monday, the prosecution
described her death as a "cold-blooded murder."

Kimberly Bemis has had custody of the girl since a probate judge removed
Treau from the custody of her parents late last year because of alleged
negligence.

State child welfare officials said that Kimberly Bemis filed papers to
obtain custody of her niece in probate court in December 2006. The court
asked the state Department of Children and Families to conduct an
assessment of Bemis' home prior to placing Treau there.

State social workers did a routine criminal background check and
reported to the court that Betancourt had a criminal record but the
charges were related to arrests that were 10 years old and did not
involve any violence against people or children, according to Gary
Kleeblatt, a DCF spokesman.

Kleeblatt said DCF is launching its own investigation into Treau Bemis'
death and whether her case was handled properly. Such reviews are
mandatory any time a child with an open or recently opened DCF case
dies, he said.
