It all happened in a New South Wales, Australia divorce and custody case. It seems this sweet old lady decided to help her daughter get custody by falsely informing the girl that her father's father was a pedophile. Granddad sued grandma for slander and won a $30,000 judgment. Even though the only people who heard the slander were immediate family members, the judge ruled she owed him anyway. So be aware; in divorce and custody proceedings, things can get ugly. A NSW District Court judge ordered the hefty payout even though only four people heard the slander, including the man's son and daughter, the Daily Telegraph reports. Judge Judith Gibson said the pedophilia allegation, made during a child access dispute in July last year, was "like pouring oil into a fire" and caused the plaintiff "anxiety and concern." "The fact that a serious defamation was published to persons who are close to the plaintiff does not make it any the less hurtful," she said. The maternal grandmother of the child at the centre of the dispute - who cannot be named for legal reasons - was referring to the girl's paternal grandfather when she made the defamatory remark. The court heard that when the man's daughter answered the door, the grandmother told her: "You know your dad's a pedophile - a complete stranger came up to me in the street and told me." The woman admitted in court that she was in a "terrible mood" and "just went off my head", the Telegraph reported. But after she failed to apologise, the grandfather launched defamation proceedings. Macquarie University's Roy Baker said most people would be surprised to learn they could be sued for something said in anger among family members. |
