Couple Jailed for Spanking Child

They say it was just discipline but their children have since been taken away by Child Protective Services. Usually, spanking your child as discipline is lawful. It�s something called corporal punishment. But this time, a woman and her fianc� were not only arrested, but placed under a $100,000 dollar bond. �I told her, "you`re gonna get a spanking, this is ridiculous, we done told you, we`re tired of repeating this same cycle." 34-year old Tracia Jones says her 14 year old daughter is always misbehaving, ditching school, and disrespecting her teachers. After so many missed classes, her daughter was being kicked out of Lubbock High and was to be placed in Project Intercept. When they got home from school that day, Jones was trying to discipline her child, giving her an old-fashioned spanking with her fianc�s belt. But instead, she and her fianc� left in handcuffs. �We got indicted for aggravated assault with a deadly weapon, and the weapon was the belt� says Jones. And her lawyer, David Moody says corporal punishment is protected under Texas law. �A parent can use force to discipline his child if it`s reasonable� he says. And Jones says she was reasonable. �Six licks with jeans on, that ain`t nothing� she says. Jones spent almost 20 days in jail, and her fianc� is still locked up. All three of her kids were taken by Child Protective Services. �I feel violated because I`ve had my kids all this time. I`m 34; I`m taking care of my kids, disciplining them. Now, Moody says he`s never seen a spanking case go this far and he thinks it should be dismissed. �I think a jury would look and say if you spank your kid with a belt, it`s probably ok� says Moody. But some say any type of spanking should be considered abuse. Alan Read with CASA feels it leaves bruises that are more than just skin deep. "The bruises, the little scrapes, the cuts, maybe even a broken bone that`s been inflicted from a parent, they will heal, or they`ll blend into the child`s life. But the emotional scars may or may not ever heal" says Read. While Jones and her fianc� have been indicted, they are still awaiting a trial date to be set. If you only knew what some people within CPS will pull though. A lot of
what happens is at the descretion of the worker themselves. I have 3 children 17,15 and 12 and I have had the police called on me for taking a belt to the 15 yr old. I was told to "use my hand" not a belt. LOL I said on a 15 year old, I asked "are you sure you dont want me to just beat him with a bag of cotton balls." Who in their right mind would try to discipline a 15 yr old with their hand - I mean the kid would just stand there and laugh! Now if your talking about a child...lets say 7 or 8, I dont feel a belt is appropriate at all. I have told my children if they dont like it where they are I will pack their bags for them after they call CPS.. You know the funny thing is they normally come to appologize for their behavior after they realize what they did was wrong. I keep reminding my children that they could go live with their biological mother if they dont want to follow the rules. My children are only expected to respect the adults in their life. Help with simple choirs appropriate for their ages, and for that they have a life that most children would only wish to have. My wife and I take the children camping, we encourage band, and any other activity they want to join in school. They have nice clothes, new furniture, and are always given more then enough to eat (I will NOT send a child to bed hungry at all!! - if they are hungry their is ALWAYS food) I take my children for rides down the freeway in the big city nearby and point out the people standing on the corner with "will work for food" signs and remind them that it happens to people that often do NOT want to obey the rules in society and feel they are to good to do what is expected of them. Her face got redder. I asked her about her recommendations to the court. I asked if they were actually her personal professional opinion or if they were her representation of her SUPERVISOR's commands. I asked if she had represented the supervisors opinions as if they were her own opinion in court. My SO's atty became intrigued with this issue. I thought this fit in with your comment about their descretion. A lot of what happens is at the descretion of the worker themselves. I have 3 children 17,15 and 12 and I have had the police called on me for taking a belt to the 15 yr old. I was told to "use my hand" not a belt. LOL I said on a 15 year old, I asked "are you sure you dont want me to just beat him with a bag of cotton balls." Who in their right mind would try to discipline a 15 yr old with their hand - I mean the kid would just stand there and laugh! Now if your talking about a child...lets say 7 or 8, I dont feel a belt is appropriate at all. I have told my children if they dont like it where they are I will pack their bags for them after they call CPS.. You know the funny thing is they normally come to appologize for their behavior after they realize what they did was wrong. I keep reminding my children that they could go live with their biological mother if they dont want to follow the rules. My children are only expected to respect the adults in their life. Help with simple choirs [chores] appropriate for their ages, and for that they have a life that most children would only wish to have. My wife and I take the children camping, we encourage band, and any other activity they want to join in school. Actually, two of the "will work for food" sign people got checked out around here and both were scam artists. One claimed he was homeless which was a surprise to several local homeless shelters. Another was offered a job and didn't want it. The scam is that they hold out such heart rending signs because lots of people will hand the guy a large cash bill. People wonder what is wrong with society today but you can blame the "liberal" whinny asses that dont think children need parenting. Sure, they want the STATE to be the parent! It's part of the Social Engineering plan, socialism inch by inch. If they did it all quickly it would be readily recognized, and people would raise hell but it's a slow gradual creeping trend. You'd think idealogically that conservatives would go after CPS agencies, but they rarely do. If they're giving the agencies enough rope to hang themselves, aren't we THERE yet? |

What lesson is it that you are trying to teach them that cannot be taught another way? Don't get me wrong, I am an advocate for CP, but having numerous children of my own, both over and under the age you speak of, I don't find that CP is the best method for children over the age of about 12. Each of us must of course judge our own kids and what works with them, but I find that with children over a certain age that other forms of consequences work much better, have a bigger impact on their actions, than a spanking. Denial of privileges being the first thing that comes to mind. You'd be amazed at what I can consider a privilege. I have told my children if they don't like it where they are I will pack their bags for them after they call CPS.. Not a bad answer, but not a good one either. This should be a last resort. I have explained to all of my kids that until the day they call CPS they are welcome in my home, and that a call to CPS by one of my children tells me that they no longer wish to live with the rest of the family and are wanting to go elsewhere. To date none of them has taken this last step. Not even any of my foster children, and I have had many. Anything not forbidden is allowed gregg. My contract says that I am not allowed to disparage the Childs parents. Other than that there is little that CPS forbids in the area of speech. Oh, and BTW gregg, they are not charges, they are children. I'd explain the difference to you, but given that I have tried to do so for more than 5 years now I don't think you are any closer to a clue now than then. How do you think CPS would write this up in an investigation? Not my concern. Any child in my home, foster or otherwise, can call CPS anytime they wish. They know the consequences for such an action. And after more than 200 of them none has made that choice. What happens after that call, well of course I am concerned about the child, but not the consequences of their choice. Its an adult thing gregg, obviously something you have failed to learn over the years. Actions have consequences, both good and bad. All actions. And as adults we must deal with those consequences. If a child is adult enough to call CPS then they are adult enough to deal with the consequences of that act. And if not, well then that's why I spell it out for them quite early in they stay in my home. Ron |
