child support in Ontario - anyone with info....??

Default child support in Ontario - anyone with info....??

Just a bit of a history...

- I have a small business - losing $$ right now (I have some income
from it, so its stays a business - but my leased vehicle expense vs
business income is greater).

- I am employed full time

So.. that gives me a little bit of a tax break right now -- however,
it pulls down the 'line' that the FRO uses to calculate my child
support payments...

being a nice guy - I said to my ex, I'll pay child support from my T4
of last years employment income (which is higher than the income tax
'total income' line). So.. I roughly calculated my earnings from
last year and have been paying her on that... My actual T4 came in..
and it seems I've been over paying her each month (about $100 extra
she has been getting).

- Now, she isn't happy - she is going to get a job - ( finally after
14 years -- likely to support her unemployed b-f and to compensate for
her failed business venture) -- BUT she expects me to pay 1/2 of the
babysitter costs - on TOP of what I already pay her for child support
(I do volunteer to pay 1/2 of the day care costs now - which is dirt
cheap since she has subsidy and no income).

- I'm already at a loss each month of over $600 after I pay her child
support - and am quite likely going to have to file for bankruptcy
next month... if I can't get rid of my leased car.

My question is this - I can't afford a lawyer right now ($300/hr is
the cheapest I've found).... if anyone knows the legal system in
Ontario and can give me some advice on what my obligations are - over
and above the calculated amount from the FRO online calculator.. I
would love to hear!

I've spoken to a couple people and they say its not my responsiblity
to pay for a babysitter... child support is calculated on the FRO web
site.. and thats it... anything else is 'voluntary'..

Can anyone shed some positive light on this? If I have to pay her
more.. I go bankrupt & live on the street..... and lose a shot at a
career I've been dreaming of and am very very close to getting it now
(which would be higher earnings... resulting in more $$ for her.. so I
don't get why she's trying to screw me over right now).

Anyway... help if you can ??

From my experience, also in Ontario, the judge uses the extraordinary

expense to increase the amount payable per month to include daycare
costs.

The guidelines are supposed to be so comprehensive that they should
have already included daycare costs if they represented the expenses
of raising a child in the last 20 years. Or....maybe it is just
convenient double dipping that the judges in Ontario are willing to
orchestrate and create precedence beyond the intent of the
legislation.

Daycare costs are calculated based on the percentage of the total
income of both parents that your income represents i.e. if your the
only one earning an income you might be looking at paying the whole
daycare cost. However, if she is not working, why does she need
daycare?
