In papers filed in U.S. District Court in Providence today, the state says the lawsuit interferes with the jurisdiction of the state family court and should be dismissed. The lawsuit was filed by state child advocate Jametta Alston on behalf of 3,000 children in state custody. It says some children have been seriously injured or even killed in foster care. But the state says the lawsuit asks the federal court to second-guess decisions by the family court. It also argues that Alston is required to intervene with the family court if a child is in jeopardy, but says she failed to do that for the children listed in the suit. Alston did not immediately return a phone message seeking comment. Susan Lambiase, a lawyer for the group Children's Rights, says the state is unfairly trying to prevent the children from having their day in court. (Copyright 2007 by The Associated Press. CPS perpetrates more abuse, neglect, and sexual abuse and kills more children then parents in the United States. If the citizens of this country hold CPS to the same standards that they hold parents too. No judge should ever put another child in the hands of ANY government agency because CPS nationwide is guilty of more harm and death than any human being combined.
