CINCINNATI - Attorneys for the Clermont County couple charged with killing
their 3-year-old Middletown foster child want to change the location of
proceedings in Hamilton County.

Liz and David Carroll Jr. are being held in Hamilton County Jail while they
await charges related to the abuse, death and false kidnapping of March
Fiesel, a developmentally disabled boy placed it the couple's care in May.

In Clermont County, the Carrolls face several felony charges, including
murder, kidnapping and child endangering. In Hamilton County, they face
charges related to the alleged disappearance of Marcus from an Anderson Twp.
park, a story police said was concocted by the couple after the boy had been
dead for nearly two weeks.
Hearings have been scheduled in Clermont County Common Pleas Court for
motions to change the venue and to suppress certain statements made during
the Carrolls' arrest.

This week, defense attorneys said potential jurors have been damaged by the
media attention this case received.

"The premium on impartiality is extremely important in this case because it
is so closely related to the pending murder case in Clermont County," wrote
David Carroll's attorneys in a brief electronically filed Sunday. "A
presumption of prejudice is well established by the volume and content of
the media's coverage of this case."

Hundreds of volunteers scoured the Julifs Park area in search of Marcus
after the Carrolls reported him missing after Liz Carroll allegedly passed
out due to a medical condition.

Prosecutors say the couple bound Marcus in a blanket with tape and left him
in a closet while they vacationed in Kentucky for two days. When they
returned, Marcus was dead. David Carroll is accused of taking the boy's body
and burning it in rural Brown County. They were arrested Aug. 28.

"Ultimately, the conclusion must be that this county has been so saturated
with the facts underlying this case that it is impossible for (David) to
receive a fair trial ..." the brief stated.

The Carrolls' attorneys say the couple "involuntarily" made statements to
police without understanding their rights to remain silent.

The motions will be considered Oct. 30 through Nov. 2 for Liz and David
Carroll in Hamilton County Common Pleas Court.

So tell us, Bob the Constitutionalist, how do you reconcile your
support of rights of citizens with you having prejudged their guilt,
and thus apparently, do not feel they are entitled to as impartial a
jury as is possible under our system, as is their right?

Aren't you just a tad confused?

They may be guilty, but I'm not prepared to say, "hang'm high" until
that guilt is established by our system, that very one you claim to
know so much about....but keep missing the mark, just like this.

So, am I correct in assuming you feel they should not complain, and
that they should not have the most impartial jury possible?

Speak right up, boy.

"Never heard of..." is not necessary. Just not being innundated, as
locals would be, of course. Change of venue for this reason is common
in trials. You have a problem?

You want rights for parents, don't you? Double standard?

Have you ever looked into how jury selection is done? They don't rule
someone out simply because they have knowledge of a case, but for how
they perceive the case after hearing information about it.

Defense attorneys actually do work for their money.

So do prosecutors.

Finding out how they percieve the accused and the victims and the case
is the key. It's just easier out of the community.
