MICHIGAN: Attorney General Mike Cox Hails Passage of Child SupportBills
God help the dads in Michgan.
Thursday December 9, 4:35 pm ET Bills will make for better support collection system in Michigan LANSING, Mich., Dec. 9 /PRNewswire/ -- Attorney General Mike Cox greeted the passage of six bills today that will help in the collection of unpaid child support. The bills concurred in today were House Bills (HB) 5372 and 5373, and Senate Bills (SB) 1447, 1448, 1449 and 1450. "Unpaid child support is at epidemic levels in Michigan," Cox said. "Michigan ranks as the third worst state when it comes to the amount of owed child support payments, and I congratulate the legislature on taking an active role to make a difference for our children. Our kids deserve better, and these bills are a significant step in the right direction." Highlights of HB 5372 include amending current law so that if an individual is arrested on a felony warrant for child support nonpayment, the court would require the individual to remain in custody until the preliminary exam unless the individual deposits a cash performance bond. HB 5373 amends current law to specify that an individual arrested for nonpayment would remain in custody until arraignment unless the individual posts a cash bond of at least $500 or 25% of the arrearage, whichever is greater. "This bill makes a clear statement that neglecting your children's basic needs will not be tolerated and you will go to jail for not paying child support," said state Representative Mike Nofs (R-Battle Creek), sponsor of HB 5373. "By establishing stiffer penalties, we aim to decrease the number of parents shirking their responsibilities." Highlights of SB 1447 through 1450 include providing a lien on an individual with past due support. The lien could be on an inheritance, a claim for negligence or personal injury, and funds due from a settlement, civil judgment, arbitration award, or worker's compensation. The bills also mandate that a Title IV-D agency notify the "child support lien network" (CSLN) when an individual's arrearage exceeds twice the monthly payment amount. "I was glad to introduce this legislation cracking down on people who fail to pay their child support," said state Senator Tony Stamas (R-Midland), sponsor of SB 1449. "It makes perfect sense to make insurance claims subject to child support collections. Raising children is a hard and costly job for any parent. The least we can do is make sure deadbeat parents receiving insurance claims make good on their overdue child support." The bills will take effect immediately upon the Governor's signing. Since when do BASIC NEEDS and child support have anything to do with each other? BASIC NEEDS are food, clothing, medical, and a place to stay. If that's all that NCP's had to pay, we might see a much higher compliance rate. I pay $560 per month plus all the medical insurance (another $200/mo). Assuming that's half of my child's needs then the total I lay out is $760/mo. Are you seriously going to say that it takes over $1500 a month for BASIC NEEDS? Cox is full of ****. Oh yeah, you guys just haven't been shaking us down hard enough...thats the key. The bills will take effect immediately upon the Governor's signing. He's the one that had posters put up showing dads in handcuffs and ran a contest where kids could win a prize for drawing the best "child support" poster kids or whatever. He's the master of the cheap shot. Much of the supposed "owed money" has already been paid but is lost in their system. Checks come up missing on her end when I've never missed a payment on mine. When we compared notes, there were several hundred dollars that just never showed up. When she called to ask about it she made 3 calls and got 3 different answers! Instead of trying to beat a dead horse twice as hard, they need to clean up their own act first. It's a classic game of shining the light at some diversion so that nobody notices the incompetence of the people that are "managing" the money. I'd love to see someone that had the means go after these bloodsuckers and find out exactly where all the money is going. The reality is that they keep you so broke that you can't chase it down. You have to understand that the DA's office will not prosecute any case that they cannot win, it's bad for business. Deadbeat Dads are a favorite because they are easy prey and make the prosecuted statistical numbers look good for Cox. At present, people like Cox are free to do what they like as there is nobody to seriously challenge them! What is needed is one national organization that can put on a united front! There are 17,000,000 million of us, could you imagine the power we would have if we all just kicked in 10 bucks to finance a legal team to take up our issues? We don't have to take on the whole system at one time, we target individuals in the system like Cox and watch the house of cards fall apart as others are put on notice that they will be held accountable for their actions. Things have to change, but nothing changes unless we take action to defend ourselves from these political predators!!!! |
