AUSTIN – Judges who handle child-abuse cases in Travis County have
barred the state from housing the county's foster children in offices of
Child Protective Services.

The only time CPS could have a Travis County youngster stay overnight in
its offices would be in the first eight hours after initial removal from
the child's birth family – basically, in the middle of the night.

The order, signed by 10 state district judges, takes effect July 1.

CPS spokesman Patrick Crimmins said Friday that there are no Travis
County foster children staying in state offices.

Since Jan. 1, nearly 500 children statewide have slept in CPS offices or
hotels because the state couldn't find a suitable and willing caregiver.
Mr. Crimmins said only six of those children were from Travis County.
They spent a total of seven nights in state offices, he said.

Though the judges' order may have only limited effect, it signals
courts' growing dissatisfaction with the office sleepovers.

The Travis County judges deplored such stays as "not in the best
interest of children," "not appropriate for meeting the child's needs"
and "not the least restrictive environment."

The office sleepovers are caused by foster-care providers' increasing
unwillingness to accept the youngsters, most of whom are in their teens
and many of whom have had more than 10 different placements while in
state care.

The state blames about 100 private child-placing agencies for declining
to take in the deeply troubled children, while agencies point to newly
tightened standards and bureaucratic incompetence.

District Judges Darlene Byrne and Jeanne Meurer mailed the judges' order
to the two lawmakers who head panels that write child-welfare
legislation: Republican Sen. Jane Nelson of Lewisville and Democratic
Rep. Patrick Rose of Dripping Springs.

Judge Byrne and Judge Meurer said there are about 1,350 Travis County
youngsters in state care, and the number is rising.

The order also requires approvals from the attorneys appointed to watch
out for the child's interests and other child advocates before CPS
changes placements, except during emergencies.

And the state would have to give more notice to the children's
representatives before it changes a youngster's "level of care" – a
rating that decides how much the state pays caregivers. Changes often
trigger movement of the child, from a foster home to a treatment center,
or vice versa.

It is sickening how many children are subject to abuse, neglect and even
killed at the hands of Child Protective Services.

Imagine that, 6.4 children die at the hands of the very agencies that
are supposed to protect them and only 1.5 at the hands of parents per
100,000 children. CPS perpetrates more abuse, neglect, and sexual abuse
and kills more children then parents in the United States. If the
citizens of this country hold CPS to the same standards that they hold
parents too. No judge should ever put another child in the hands of ANY
government agency because CPS nationwide is guilty of more harm and
death than any human being combined. CPS nationwide is guilty of more
human rights violations and deaths of children then the homes from which
they were removed. When are the judges going to wake up and see that
they are sending children to their death and a life of abuse when
children are removed from safe homes based on the mere opinion of a
bunch of social workers.

ARE "FAMILY UNFRIENDLY" IN THE NEXT ELECTION...
