State Looks At Foster Care Reporting After Child's Death http://www.ketv.com/news/14314741/detail.html LINCOLN, Neb. -- Nebraska Gov. Dave Heineman said the state needs to be more revealing about cases of adoption that involve foster children. State leaders are revisiting foster-care laws after Joleet M. Poole, 23, was charged in the death of a foster child he was hoping to adopt. Poole was charged last week with child abuse resulting in death after Davion Winrow, 1, died at a hospital of head injuries. Douglas County Attorney Don Kleine questions why Poole was ever allowed to pursue adoption. Juvenile court records show that Poole stabbed a boy in 1992. Soon after, his mother's parental rights were terminated. Kleine said that after living his whole life in foster care, Davion had recently gone to live with Poole as Poole considered adoption. "We need to disclose more information, not less information about these situations," Heineman said on Wednesday. Davion's case has some state leaders considering whether the public should know what role the Department of Health and Human Services had in the decision to allow Poole to watch the child. "All of us will benefit on how these choices were made," said state Sen. Gwen Howard. When a state ward dies, HHS said it can only report whether the child was a state ward, and for how long, as well as whether the child had any siblings in state custody. State Sen. Ernie Chambers said there is a fine balance between the public's right to know and a family's privacy. "The key is how the legislation is handled," Chamber said. Lincoln pediatrician Dr. Stacie Bleicher is a child advocate who, in 2003, served on a governor's task force that investigated child deaths. She said on Wednesday that she believes the balance must be met in order to protect kids. "What do we use as screening tools for prospective adoptive parents? What different things are looked at in their past?" Bleicher said. The governor has looked at some of the facts, he said, and while he would not yet say whether he has confidence in the way HHS handled Davion's situation, he said that in general, case workers do good job. Howard said she's going to draft legislation that will address these issues. If convicted, Poole faces a maximum penalty of 20 years to life in prison.
