California Acknowledges Rights of Parents!

HSLDA is posting the following information from a Legislative NEWSFLASH by
Roy Hanson and Jim Davis of Family Protection Ministries (FPM).

We are very grateful to God for an encouraging victory for every family in
California. AB 2749 was signed into law by Governor Schwarzenegger. AB 2749
provides two important protections for all parents who are investigated by
Child Protective Services for child abuse or neglect.

1) AB 2749 requires that "a representative of a child protective services
agency performing an investigation ... of suspected child abuse or neglect
...., shall advise the individual of the complaints or allegations against
him or her...."

2) AB 2749 specifically requires child protective services social worker to
be trained concerning their duties "to protect the legal rights... of
children and families..." they are investigating. In accordance with the 4th
Amendment to the U.S. Constitution, which protects your privacy and the
privacy of your home and property, social workers should now be trained that
they can only enter your home under one of three conditions: 1) if there is
a likelihood of imminent harm; 2) if they have a warrant issued by a court;
or 3) if they have your permission.

This bill was possible because HSLDA successfully amended the federal Child
Abuse and Prevention Treatment Act to include the above two provisions as a
condition for the state to receive federal funding. Beginning in late 2003,
Roy Hanson and Jim Davis of Family Protection Ministries began working
behind the scenes with HSLDA and Assemblymember Bob Dutton of Rancho
Cucamonga. Since this was a parental rights issue and we did not want it to
be perceived as a homeschool issue, FPM asked California Family Council to
be the official sponsor of this bill. FPM then enlisted other organizations,
whose bipartisan support allowed AB 2749 to pass through the legislative
process relatively smoothly.

No action is needed on this bill.

It has been our privilege to work with FPM, and we thank those who also
worked with FPM to get this bill through the legislature and these two
important provisions signed into law. This would be an appropriate time to
show our appreciation and support for Family Protection Ministries by
