Is it true that if a child is pickked up late in the evening and
returned in the morning early it counts as a 24 hour period in adding
up percentage of time with that parent? That is what a friend of mine
was told in court in Sonoma County CA

Generally, the guidelines for parenting plans suggest using overnight stays
as the way to determine the percentage of time with each parent. Each state
has its own statutory definition of the amount of parenting time to be used
for making adjustments to CS awards. In my state the limit is 20%, or 73
overnights per year.

However, if the parents can agree and the court approves, the parents can
use other criteria for determining the percentage of time spent with each
parent. Examples of these plans could be children spending the daytime with
one parent but sleeping at the home of the other parent to avoid having to
pay for child care.

Is your friend trying to maintain a higher percentage of custody for
him/herself? Does this have to do with monies paid for child support? Does
your friend want to keep the amount paid to her as high as possible? Or is
your friend a father that would like to pay less?

My friend is the mom who is trying to get the child support set from
the noncustodial father who had the kids 3 nights a week from 7:00 pm
to 6:00am when he would drop them back to her and the court said that
each of those three nights were 24 hours so he had the kids 72 hours a
week which made the percentage way higher than it actually was and
actually that time there mostly sleeping and don't need much care so it
does not seem fair and her child support was way lower than what she
thought due to that high percentage of time they figured from the
overnites.

So I'm sure, then, that she doesn't count the 4 nights they sleep at her
house as time they are with her, right? Does she count the time they are at
school as time they spend with her? What expenses does she feel she is
missing out on with the lower child support she is receiving? It seems that
both parents have to provide a home for the children. That is the major
expense that both of them face. So is it food she needs more money for?
Clothing? School supplies? I'm trying to get a handle on why she feels she
is being short-changed.
