A Virginia couple has filed a federal lawsuit against 1st Judicial
District Chancellor Richard Johnson for alleged civil rights violations
stemming from a Washington County child custody case.

Vicky and Scott Taylor, of Chesterfield County, Va., filed the suit
Thursday in U.S. District Court, Greeneville, on behalf of themselves
and four of their children.

The suit alleges Johnson violated the couple’s rights to due process and
caused severe emotional injuries to the family by denying them custody
and visitation with the woman’s 12-year-daughter without conducting a
hearing, without reporting allegations that they abused the girl to
authorities and without appointing a guardian to investigate the
allegations for the court.

Johnson said Friday that he had not yet received notice of the lawsuit’s
filing and, that because of the volume of his caseload, he did not have
any recollection of the Taylors or the circumstances of their case.

The chancellor refused to comment on the allegations, saying, “I will
let my attorney, the attorney general of the state of Tennessee, do my
talking.”

The lawsuit states that on July 21, Johnson issued a restraining order
preventing the Taylors from retrieving the girl from a two-week visit to
see her father, Donald Wise, of Johnson City.

The Taylors said the ruling was based on false allegations that they
mentally and physically abused the girl and her 21-year-old brother.

According to suit, Johnson failed to report the allegations to child
protective services as required by Tennessee law.

The lawsuit also states that Johnson failed to appoint a guardian to
investigate the allegations as required by procedural rules governing
Tennessee courts.

The Taylors alleged Johnson also denied them their right to a hearing of
the abuse allegations within 15 days of issuing the restraining order
and instead conducted the first hearing in the case on Nov. 14.

At that hearing, the lawsuit states that Johnson ruled the girl would
remain in Wise’s custody “even though no investigation of the (Taylors)
had been conducted” and “no proof or evidence to support the
allegations” had been presented.

The lawsuit also contends Johnson is “personally well acquainted” with
Wise and his parents and he “exhibited biases” during the November
hearing by communicating with Wise while “pointedly ignoring” Vicky Taylor.

The lawsuit alleges Johnson denied Scott Taylor any opportunity for a
hearing.

In an order issued in May, Johnson ruled that he was “a non-party” to
the custody case even though Scott Taylor “has essentially been (the
girl’s) full-time ‘dad’ since she was age 2.”

The suit alleges Johnson has allowed Patty Taylor to have two brief
visits with her daughter and no other contact with the girl since July 2006.

The lawsuit also alleges Johnson has barred Scott Taylor from any
contact with the girl for almost a year, causing “much grief, heartache
and mental suffering” to their entire family and especially among the
girl’s younger siblings.

killed at the hands of Child Protective Services.

Imagine that, 6.4 children die at the hands of the very agencies that
are supposed to protect them and only 1.5 at the hands of parents per
100,000 children. CPS perpetrates more abuse, neglect, and sexual abuse
and kills more children then parents in the United States. If the
citizens of this country hold CPS to the same standards that they hold
parents too. No judge should ever put another child in the hands of ANY
government agency because CPS nationwide is guilty of more harm and
death than any human being combined. CPS nationwide is guilty of more
human rights violations and deaths of children then the homes from which
they were removed. When are the judges going to wake up and see that
they are sending children to their death and a life of abuse when
children are removed from safe homes based on the mere opinion of a
bunch of social workers.

REFORMING OR ABOLISHING CHILD PROTECTIVE SERVICES ("MAKE YOUR CANDIDATES
TAKE A STAND ON THIS ISSUE.") THEN REMEMBER TO VOTE ACCORDINGLY IF THEY
ARE "FAMILY UNFRIENDLY" IN THE NEXT ELECTION...
