Default The Court Slams Haley for his OPINIONS: NO FACTS!


In the case of John and Jane Doe v. Ortho-Clinical Diagnostics, Inc.
the United States District Court Slammed Boyd Haley:

...Dr. Haley's report does not state an expert opinion that thimerosal
causes autism, rather just that he has a theory about how such a thing
could happen. At best, he expressed "strong belief" that the cause of
"neurodevelopmental disorders in infants" is exposure to an
organic-mercury compound such as thimerosal. Additionally, Plaintiffs
proffered the report of Dr. Lucier, who is an expert in methylmercury
and not ethylmercury, which is the substance in RhoGAM. Dr. Lucier does
not offer an opinion that methylmercury causes autism, but rather that
it may cause "developmental disorders." Significantly, the Court notes
that neither Dr. Haley nor Dr. Lucier asserts that he is an expert on
autism nor are they offered as such. In any event, the Court finds that
neither of the proffered reports of Dr. Haley nor Dr. Lucier are
sufficiently reliable under Daubert on the general causation issue
because neither is relevant to the "task at hand." It would be an
unacceptable scientific leap to suggest that they serve as proof, by a
preponderance of the evidence, of Plaintiff's claim that the thimerosal
in RhoGAM can cause autism.

Essentially, the court says that Haley's opinion is not that of an
expert in Autism. Why would they say that? Perhaps because they read his CV:

where there is NO mention whatsoever researching the causes of autism:

The basic research interest of our laboratory centers on biochemical and
biomedical problems involving control at the molecular level.
Specifically, we are most interested in biological systems regulated by
protein-nucleotide interactions where the bioenergetics involved are
expressed through site-specific nucleotide binding of high affinity or
through protein substrate phosphorylation. Our approach to this general
phenomenon is to synthesize novel nucleotide analogs that are
photoactive or fluorescent, or both. The analogs are then used to study
various aspects of protein-nucleotide interactions which regulate enzyme
activity. Analogs used may be modifications of the commonly known
nucleotides such as ATP, cAMP, GTP, dUTP, NAD+, UDP-Glc, etc. or probes
of the more unusual nucleotides such as the proposed alamones
guanosine-3 -phosphate-5 -phosphate (magic spot compounds) and
diadenosine-P1, P4-tetraphosphate.

These nucleotide analogs are used to study a wide variety of enzymes
that either use or are regulated by nucleotides including cyclases,
kinases, and polymerases. Certain of these probes have proven useful in
the study of the differences between normal and diseased tissues as
observed through changes in nucleotide binding proteins. Alzheimer's
disease and colon carcinoma are two of the diseases we are currently
investigating. Additionally, we have found that several of the large
polypeptide hormones (or biological response modifiers) have nucleotide
binding sites. These include IL-1, IL-2, Interferon- alpha, TNF (tumor
necrosis factor), glucagon and GH (growth hormone) from several sources.
We therefore feel that the transmembrane signaling effected by these
proteins may, at least partially, be expressed partially by an enzyme
activity associated with the "hormone" itself. This is supported by the
observation that IL-1 and IL-2 also autophosphorylate using ATP.

I also checked his list of publications and found nothing indicating
that he has published any scholarly papers on autism:

His publications end in 1999. Curiously, the only research he has
conducted pertaining to Mercury was performed on Mercury vapor, i.e.
elemental mercury.

Furthermore, he was never the lead investigator.

But he sure does make money at Altcorp...and his expert witness
fees...if he gets past Daubert...which seems unlikely.

I wonder why his anti-mercury crusade with AltCorp is not mentioned
anywhere in the UK website? Perhaps he is embarassed by it?

Interestingly, the court dismissed in a footnote, obviously because the
court did not think Haley was worth anything more.

Oh, and one last point, the Chemistry Department web page:

Many chemical and pharmaceutical companies provide lucrative internships
for undergraduates with an interest in an industrial career.
Abbott Laboratories Summer Internship Program
Eli Lilly and Company Internship Program
Procter and Gamble Internships and Co-ops

He was invited to speak from the Autism group.


Dr. Haley said. He doesn't do autism research.

He leaves it to the experts.
