By Jessica Fargen and O’Ryan Johnson Thursday, July 5, 2007 - Updated: 08:52 AM EST http://news.bostonherald.com/localRe...icleid=1009696 The Department of Social Services allowed a New Bedford child to remain in the home where she was allegedly bitten and mutilated for months after an initial complaint of abuse was lodged regarding the 3-year-old’s treatment there, according to authorities. Police arrested Massachusetts Most Wanted fugitives Jessica Silveira, 26, and her boyfriend, Bryan M. James, 34, yesterday afternooon, after the pair spent 24 hours on the lam. Their arrest came six months after the state Department of Social Services received its first report of possible abuse of Silveira’s 3-year-old in January. The horrific case is yet another example of the need for greater oversight of the troubled agency, said state Rep. John H. Rogers (D-Norwood), chairman of the House Committee on Child Abuse and Neglect. “The current system is fragmented,” Rogers said. A bill being drafted by his committee would bring all the state agencies assigned to child welfare under the cabinet-level position of Secretary of Child Welfare. A firestorm over children abused while under DSS supervision led to calls for the ouster of former DSS Commissioner Harry Spence earlier this year. Newly appointed DSS Commissioner Angelo McClain has been briefed on the New Bedford case, said spokeswoman Denise Monteiro. New Bedford police say the 3-year-old was abused for months after the initial DSS report, culminating in late April when she was brought to Children’s Hospital in Boston, her tiny body and face marred by human bite marks. Doctors at Children’s Hospital termed her injuries among the five worst child abuse cases they’d ever seen, according to police. The toddler had human bites on her face so severe she lost part of her upper lip, police said. Her ear was so disfigured that surgery couldn’t bring back its natural shape. At that point, after involvement with the family for more than four months, DSS took custody of the girl and her 5-year-old brother, Monteiro said. Monteiro said it was unclear yesterday how much involvement DSS had with the family. The agency also did an assessment in March, she said. According to a police statement, Silveira hid James’ assaults on the child from DSS. “The detective . . . noticed a pattern developing in regards to keeping the assault from DSS as well as other health care workers,” police said. “At this time we believe that the live-in boyfriend was the individual that caused the injuries to the child and that the mother was trying to cover up the assault.” Rogers’ bill calls for training medical professionals in early warning signs of abuse. “We want to make sure there’s early detection of problems,” Rogers said. “The problem with the old system and the current system is that it lacks medical experts. The problem with the medical experts is there’s not a lot of knowledge on what is child abuse and what is child neglect.” James’ neighbors on Newcomb Street said he was a “decent guy” and doting dad who played in the snow with the 3-year-old and her brother. Neighbor John Costa said the cut on the 3-year-old’s lip is not a bite wound, but happened when the toddler fell down. “I know he didn’t do it,” said Costa, who has known James for 22 years. “He was a decent guy.” A relative who answered the phone at Silveira’s family’s home in New Bedford only had this to say about the accusations: “Jessica is a wonderful mother.” CURRENTLY CHILD PROTECTIVE SERVICES VIOLATES MORE CIVIL RIGHTS ON A DAILY BASIS THEN ALL OTHER AGENCIES COMBINED INCLUDING THE NATIONAL SECURITY AGENCY/CENTRAL INTELLIGENCE AGENCY WIRETAPPING PROGRAM.... CPS perpetrates more abuse, neglect, and sexual abuse and kills more children then parents in the United States. If the citizens of this country hold CPS to the same standards that they hold parents too. No judge should ever put another child in the hands of ANY government agency because CPS nationwide is guilty of more harm and death than any human being combined. CPS nationwide is guilty of more human rights violations and deaths of children then the homes from which they were removed. When are the judges going to wake up and see that they are sending children to their death and a life of abuse when children are removed from safe homes based on the mere opinion of a bunch of social workers.
