It is amazing the things that generate lawsuits these days. I was in Japan a few years ago and had the opportunity to visit a lovely island near Hiroshima. In addition to a great many tiny deer with no fear of people, I visited a shrine with a bell at the top. This bell was mounted on a 10-foot cube of granite with stairs leading to the top. A small cliff stood on one side of the cube, descending about ten feet from the base before gradually angling out into a lightly forested hillside. If you fell off the cube on that side, you'd probably fall about 20 feet before rolling down a steep hill into some trees. I was amazed that there were no fences around the top of the cube, nor any posted warnings. In America, of course, there would be a ten-foot-high fence around the top of the cube with signs that said, "DANGER -- sharp drop -- do not climb fence!" And someone would probably get good and liquored up, climb the fence, dance around on top of it, and sue the park after they fell and broke their leg, claiming that the sign wasn't visible enough. And they just might win. I later learned that the entire nation of Japan has fewer lawyers than Long Island. Sad and interesting, eh? - Ron ^*^ |

In the US, the law is up every orifice and down every cravasse our our persons. I dare anyone to get through the day without breaking some law somewhere. In reality, I haven't seen much enforcement. My 11 year old got popped on the ear leaving bruise marks but the school simply told the kid not to do it again and changed his seat. I prefer criminal charges when criminal law is broken and last I knew, assault is a crime. For some reason, police prefer to let the school handle these things but schools have little penalty power. That criminal acts are permitted on school property but nowhere else is ludicrous. If my kids are assaulted again, I will insist on criminal charges. == |
