Default Trevino caught at last!!

Viola Trevino, who ran from the law for, among other things, filing a false
claim for C$ for a child that didn't exist, was finally caught and brought
to court to face her crimes.

Couldn't have happened to a nicer person.

Woman who faked having child pleads guilty to felonies

Associated Press - August 2, 2008 2:55 PM ET

ALBUQUERQUE (AP) - A 55-year-old Albuquerque woman who pretended to have a
child to get thousands of dollars from her former husband has pleaded guilty
to 13 felony charges.

Viola Trevino used fake documents and a phony DNA test to get child support
from her ex-husband.

The child never existed.

The scheme unraveled in 2004 when a judge ordered her to bring the child to
court.

Authorities say Trevino paid a woman $50 to borrow the woman's granddaughter
to show the judge.

But the grandmother followed Trevino into court.

Trevino earlier was sentenced to 16 months in federal prison for filing a
false tax return in which she claimed the imaginary child.

Woman Accused Of Creating Fake Child Makes Plea Deal
Viola Trevino Enters Pleas For 13 Of 24 Felony Counts

August 1, 2008

The Albuquerque woman accused of creating a fictitious child to obtain
government benefits and child support appeared in court Friday.

Viola Trevino's plea bargain begins the final chapter of a case that made
national headlines.

Trevino is accused of faking the existence of a child, then bilking the
government out of thousands in benefits and her former husband out of tens
of thousands in child support.

The plot included fictitious DNA tests and even a baby taken off the street
for an appearance in family court.

"Ms. Trevino took the little girl Delilah Chavez away from her grandmother
against her will for the purpose of using her in a court proceeding," said
prosecutor Elizabeth Counce.

Trevino, 55, is entering pleas in 13 of the 24 felony counts against her,
which could have put her in prison for the next two decades or more.

Shelly Barreras shared the nightmare her husband Stephen, Trevino's former
husband, went through, trying to get back nearly $20,000 in support Trevino
obtained by fraud.

"I'm happy," said Barreras. "I never thought I'd see the day she would stand
up and take responsibility, and it's about time."

She's pleased Trevino will do hard time, but disappointed that the time will
be capped at six years by the plea arrangements.

"She was looking at a total of 48 years and I would be happy with half of
that, but six is definitely not justice," said Barreras.

Trevino will be sentenced in mid-October.

Trevino entered pleas in 13 counts, including false imprisonment, fraud,
conspiracy and five counts of perjury for lying about her actions in court.

No, the scheme unraveled back in the 70's when the government gave more
rights to women to enable them to steal from the men that fathered their
children.

Where's the government's responsibility here in a clear case of fraud that
they did nothing to stop or at least investigate at the beginning of this
farce? She has 24 felony counts and fathers do way more time with just one
felony count for being too poor to pay these idiot C$ rates!!!!!!!!!!!

Any money she only does over a year? LOL

Hell in this country a woman can murder her husband and still do no time!

This is no time for celebration, it only shows how pathetic the system
really is!
In the mean time, she put $20,000 plus in her pocket that she doesn't have
to pay back.

I'm glad she is finally going to face the music for what she did. But until
they make her pay back what she stole--under the same potential consequences
that a father faces for not paying child support--then it really is only a
slap on the wrist. So: wage garnishment in the amount of 20% of her gross
salary. Whatever te state charges as interest on CS arrearages, monitoring
of her bank accounts to detect any extra moneys that might appear, grabbing
her tax refunds, and threat of losing her drivers lecense if she misses any
payments, and jail if she misses more than a couple of months no matter what
the reason. And she should not have to be taken to civil court to get this.
The man she bilked has been through enough. Let the family court system
handle it.

Good Call Teach!

In addition her future wages should be assumed at a much higher rate than
what it actually is and 25% garnished at that rate as mine was.
