DeLeon faces sentencing Friday
KXLY.com Staff Last updated: Friday, July 20th, 2007 08:35:54 AM http://www.kxly.com/news/?sect_rank=...story_id=12978 SPOKANE -- In a plea deal that's drawn anger and criticism, on Friday a Stevens County woman who originally faced murder charges for the death of her adopted son will likely be sentenced to just six years behind bars. Carole Deleon pleaded guilty last week to criminal mistreatment for the death of her adopted son Tyler in 2005 and the abuse of another foster child. Carole originally faced life in prison if convicted in Tyler’s death, but a deal cut with Stevens County Prosecutor Tim Rasmussen and DeLeon’s attorney spared her from murder charges and prevented a lengthy sentence. “Tyler should get his day in court," Florence Moyle, whose nephew was cared for by DeLeon, said. The day she learned of Tyler DeLeon's death Florence promised him he'd get justice. “I told Ty that moment, I'm not going to let this ride. I'm going to push it," she said. Like Tyler, Moyle's nephew Steven lived with Carole DeLeon. She was his foster parent and Steven was once featured in a KXLY 4 Wednesday’s Child segment. Florence says that like Tyler, Steven was abused. Both were grossly underweight, denied drinking water and suffered broken bones and bruises. Tyler's little body eventually gave in on his seventh birthday in 2005. “This little boy didn't go quickly. This mother didn't harm him in a rage. She didn't get mad and push him or stab him or smother him like other parents have. This mother didn't feed this child for five years," Florence said. The sad story of Tyler's life lies in the details, thousands of pages, too much background for a boy who died so young. It includes nine full pages of his medical history detailing bruises on his face, a broken leg, teeth knocked out and bruises on his back. Ty's doctor placed him on at least four different medications to treat his behavior problems including Zoloft at age five. Every single drug he was prescribed lists dry mouth as a potential side effect and yet Tyler's mom went as far as to place a lock on his door to keep him from sneaking water at night. Even though Tyler's doctor treated him for dozens of injuries and illnesses he never once reported any concerns about abuse to the state which he is legally required to do. He didn't even report that Tyler stopped growing at age three. But, according to the state's own report, Ty never should have been in Carole's home to begin with. Carole had three children taken from her years before for abuse and neglect in Wyoming; the State of Washington says it never knew that. However they can't plead ignorance with their own reports. State reports reference a Child Protective Services referral from July 2004, six months before Tyler’s death, in which the state determined "the children in the DeLeon home were at high risk for future abuse and neglect." The state not only left Ty and four other children in Carole’s care after that but they placed a three- month-old baby with her as well. Then after Carole’s arrest in Tyler’s death, the state’s complicity continued. Even though a judge ordered Carole not to have contact with her children a state investigator helped her send them cards and letters. For all those reasons, Florence Moyle believes Carole DeLeon should face the harshest penalty possible and she says little Steven agrees. In fact, he was prepared to testify in DeLeon's murder trial. “I think the only criminal mistreatment here, beyond what Carole did, is done by the prosecutor,” Florence said. “By even thinking that this is OK, by thinking this is acceptable." Prosecutor Tim Rasmussen has said he wanted to spare DeLeon's children and foster children from re-living their abuse but Florence believes that's a cop-out, calling the deal unfair, unjust, and denying Tyler the justice she promised him. “I think she deserves to spend the rest of her life in jail personally," she said. Florence Moyle is now planning a protest with several other people outside the Stevens County Courthouse before the sentencing begins Friday. Meanwhile in Seattle a law firm there is planning to sue the state and others involved on behalf of Tyler's estate and the other children removed from the DeLeon home. A DSHS representative contacted for this story says changes have been made to the system in the wake of Tyler’s and other children’s cases and those measures have led to a decrease in re-abuse by 25-percent.
