Not knowing the child was his until 15yrs later

Default Not knowing the child was his until 15yrs later

My husband is having to pay not only child support but back child
support for a child he did not even know was his. She married and the
birth certificate has the other man as the father and the child was
named after this man. They were only married a few years and when he
tried to get custody she pulled the DNA surprise and it was not his.
15yrs later the state knocks on our door saying my husband owes for the
child. We had a DNA test and my husband is the father but is it right
that he has to pay for a child he has never seen and the other man was
duped into believing it was his child. I understand a child has a
right to be supported but he also has a right to know the truth
regarding his real father. Why did it take so long for the state to
demand child support. Does my husband have any legal recourse
regarding having to pay the back child support?

What kind of back child support is he being charged? My husbamd found out
he was the father of a then-13-year old a few years ago. He only had to pay
2 years of back child support, plus current support until the young lady is
19 or graduates high school. What state are you in?

how about this: when the father first learns that the child is his (not
when he is notified), that's when support starts. Giving the state the
power to retroactively go after child support all the way to when the
child is born is like giving an alcoholic the key to your wine cellar.
Doing this would recognize that the father is NOT a criminal: he didn't
deliberately abandon his child. He had a one night stand, doesn't mean
any blame on him or on her. But you cannot be held responsible for a
debt you don't know exists nor should you be.

"Shouldn't be" and "aren't" are 2 different things, though. Big Daddy
Gubmint wants, and wants, and wants. And takes all it can get.

A woman can cut off contact with the bio dad and he does not hear a word
from her in years.

She can file a CS claim in any state and the court is not held liable to
personally inform him.
It becomes a criminal matter when the arrearages amount to over $5000 and a
felony warrant is put out for his arrest. He gets pulled over for a speeding
ticket and is arrested and taken into custody. This could take a few weeks
to resolve if he is in another state, because extradition hearings are
needed to transport him over state lines. In my case, I spent 36 days in
detention and I did lose my job too.
(While there, I did learn where Bob Barker invested his money and how they
also charge $15 for 5 minutes on their phone system. Lets not forget the
in-house cantina with extortionate prices!
Even the prison system makes money from your deadbeat soul)

On the day of my hearing where I thought i was going to sort this nightmare,
I was handed a summons for $42,000 and told to sign a demand for payment in
the amount of $1200/mth or go to prison from 1 to 4 years. SUre I signed
it, but how do you pay that amount making only $10/hr?
Further more, because I just immigrated here from Canada, I'll now be
deported for committing a felony crime involving moral turpitude. (I could
have stolen a car and not been deported)

It all makes perfect sense, I'm sure the politicians are very proud of their
performance record!
