Hearings to continue in Lifeway's license revocation

New Carlisle-based Lifeway for Youth, one of the state's largest foster
care agencies, was depicted as negligent in its oversight of its foster
care homes, during the first week of hearings over a state attempt to
pull the company's license to do business.

The August death of 3-year-old Marcus Fiesel of Middletown, one of
Lifeway's placements into foster care, captured statewide attention last
year.


The Ohio Department of Jobs and Family Services is seeking to remove
Lifeway's license, accusing it of insufficiently monitoring the homes in
which it placed foster children. Lifeway attorneys say the state is
trying to make the agency a scapegoat in Fiesel's death.

This week the state introduced seven witnesses, said Dennis Evans,
spokesman for the Ohio Department of Job and Family Services.

They included a former Lifeway employee and staff from the ODJFS who
were involved in recertifying Lifeway's license.

"We feel our case was presented, and the facts will be reviewed and
upheld," Evans said.

Next week Lifeway will bring in current employees to testify, Lifeway
attorney Melissa Mitchell said.

The state decided in August that it was going to focus on Lifeway, and
then it sought the evidence, she said.

"We continue to be very confident that the department is not going to be
able to make its case," Mitchell said.

Lifeway has 259 children in 117 Ohio foster homes, she said. In January
the ODJFS reported Lifeway oversaw 477 children in 308 foster homes.

The hearing officer, Chris McNeil, will accept written comments from
each side after the hearings are done, Evans said.

McNeil will make a recommendation about the license to ODJFS Director
Helen Jones-Kelley. There is no deadline for this.

Jones-Kelley can accept or reject the recommendation. If she decides
Lifeway should lose its license, the agency can file an appeal through
the courts.

If Lifeway loses its license and there is no appeal, a process would
begin to transfer foster families to work with a different agency, Evans
said.

The goal would be for foster children to stay with their same families.

A Hamilton County couple, Liz and David Carroll Jr., left Fiesel bound
in a blanket in a playpen in a closet of their home while they went to
Kentucky, according to court records. They returned two days later to
find the boy dead.

His body later was burned in Brown County, and his ashes dumped in the
Ohio River, authorities said.

Liz Carroll received a 54-year to life prison sentence, and her husband
received a 16-year to life prison sentence after pleading to a reduced
charges.

The hearings continue next week.

Imagine that, 6.4 children die at the hands of the very agencies that
are supposed to protect them and only 1.5 at the hands of parents per
100,000 children. CPS perpetrates more abuse, neglect, and sexual abuse
and kills more children then parents in the United States. If the
citizens of this country hold CPS to the same standards that they hold
parents too. No judge should ever put another child in the hands of ANY
government agency because CPS nationwide is guilty of more harm and
death than any human being combined. CPS nationwide is guilty of more
human rights violations and deaths of children then the homes from which
they were removed. When are the judges going to wake up and see that
they are sending children to their death and a life of abuse when
children are removed from safe homes based on the mere opinion of a
bunch of social workers.

REFORMING OR ABOLISHING CHILD PROTECTIVE SERVICES ("MAKE YOUR CANDIDATES
