Oh, this story just screams of a Federal law suit on it's way. ------------------------------------------------------------------ Father sent to prison for not paying child support MARLENE GARCIA, December 8, 2005 http://www.lahontanvalleynews.com/ar...News/112080017 A Fallon man was sent to prison Tuesday for not paying child support for his twin children. Jolon Thomas Farren owes more than $15,000 in support payments since his children were born five years ago, said Churchill County District Attorney Arthur Mallory. The Department of Parole and Probation recommended Farren be placed on probation so he could began making payments, but Mallory asked Judge Robert E. Estes to send the defendant to prison. Mallory said Farren, 33, did not show up for an interview at the probation department before his sentencing date, an indication that he would not follow the rules on probation. Defendants go through an interview process that covers their personal and criminal history before probation officials make a recommendation to the judge at sentencing. "The defendant's parents have indicated there are drugs involved," Mallory said. "The $15,000 is not going to get paid if you give him probation. We're asking for 24-60 months in the Nevada State Penitentiary so maybe he'll realize some things he needs to get done, and that's to pay his child support." The children's mother was in court. She told Judge Estes that Farren has only paid $150 toward supporting his children in five years. Farren said it was not until the children were 2 1/2 years old before DNA testing proved he was the father. He also alleged he was denied any visitation or contact with the twins. Defense attorney Paul Drakulich asked for probation. "Ultimately, what we're trying to do here is get this child support paid and get these children taken care of. He not going to be able to do that sitting in prison," the attorney said. Judge Estes asked Farren if he had paid any support since June 8, 2004 when a judgement was entered against him for failure to pay support. He was ordered to pay $450 a month. The defendant said he had made two payments of $20 or $40. "Mr. Farren, I understand this is not a violent offense and ordinarily the court would be quite amenable to probation...You've known this was happening for a long time and you didn't care," Judge Estes said. He sentenced Farren to 12-32 months in the Nevada State Prison. Say you have someone that had a good job at one time, but because of circumstances beyond their control (bad economy) they can't find work in their field any longer and therefore can't continue to pay C$ at the same rate. Say this fellow went to court, several times, and asked (begged) the court to lessen his C$ to a more reasonable level, but the court refused to do so. Say the judge was a pompous ass and instead of lowering this guys C$ (as the law requires when there's a "change in circumstance"), the judge RAISES it, until it reaches such a level that any arrears created would be impossible to pay off. Say this guy has spoken to several lawyers about taking the case and they keep telling him it's a lost cause and that he could be arrested on the spot if he goes to court to try to set things right. Or, because they know that the court will never listen, tell him to flee the country and start over someplace else. Now I ask you, if you where this person, what incentive would you have to go back to court, for whatever reason? Oh, I should tell you, the above actually happened, by the way. |

It's always nice to see that the doors of the debtor's prisons are
reopening. No one seems to care if these fathers will be unable to pay for their basic needs of food and shelter as long as they're shelling out the cash to some greedy bitch. |

By the time his case reached this point, there were undoutably many court hearings and ample proof that hs failure to pay was willful and not merely a result of an unavoidable shortage. I have no sympathy for true deadbeats. I sympathize with those who do the best they can with what they've got, try to keep up, yet fall behind, and find themselves entangled in the enforcement system, even though there circumstances that would have warranted a previous reduction. Their DL's are suspended and they are hauled into court every few months all to collect arrearages that, had they been able to afford legal representation, never would have occurred in the first place. =R= |

By the time his case reached this point, there were undoutably many court hearings and ample proof that hs failure to pay was willful and not merely a result of an unavoidable shortage. I have no sympathy for true deadbeats. What's the point of going to those Kourt hearing and supplying ample proof of destitution when those procedures are nothing more than window dressing? The real joke is they call this freedom & justice! LOLOLOLOL The real truth, the CS racket is nothing more than a railroad ride for all men. Sooner than later, all our son's will face this same horror too. What a monster we have created!!!! |

Family court is the only court where the burden of proof is on the defendant to prove they can't do something. In all other courts the burden of proof is on the accuser/prosecutor to prove their allegation. Let's say you were accused of not going to the grocery store. How would you set up a defense to a charge like that? |
