Questions raised about CPS decisions following girl's death
http://www.wthr.com/Global/story.asp...&nav=menu188_2 Sandra Chapman/Eyewitness News Indianapolis - The Marion County Prosecutor has files in hand that could explain why a child removed more from an abusive home was put back with a mother now accused in her death. TaJanay Bailey was found unresponsive early Wednesday from what investigators describe as a pattern or beatings spread out over days. She had just returned to her mother's home a month ago. Marion County Prosecutor Carl Brizzi has charged Charity Bailey, TaJanay's mother, and her boyfriend, Lawerence Green, in the girl's death. Now he wants to know how a child in the state's care ended up in harm's way. "Someone -went in and said it was okay for this little girl to go back into a home that she was removed from," said Brizzi. TaJanay, 3, died despite warnings from a former foster mother who reported deplorable living conditions and abuse. Also, an emergency room doctor reported bruises to the little girl's thigh and leg to Child Protective Services in 2006. But Brizzi says CPS did not get police involved. "I want to know who took her out of foster care and placed her back into that environment and who checked the house and who knew that the mother failed the drug test," Brizzi said. "We know from experience that placing a child back in the home is something that we need to monitor," said Judge James Payne, Department of Child Services. "It is primarily our responsibility to make those recommendations and to support those through the documentation." Eyewitness News has obtained some records from Tajanay Bailey's case. Inside the documents, the state had plans to reunify TaJanay with her mother as far back as February of this year. In fact, TaJanay had monitored visits with Bailey and Green. One such visit in March was moved because of Charity Bailey's living conditions and reports of drug abuse. Despite the goals for TaJanay, Judge Payne denies Child Services workers are pressured to return children to their biological homes. "The pressure will always be the best interest of the child and the health and safety of that child," said Payne. "It definitely appears from the evidence we have accumulated so far that something in fact went wickedly awry in this case," said Brizzi. The documentation is key in this case. Friday's hearing will determine whether that information will be made public so we all can see where the possible breakdown in the system occurred. While Brizzi and Judge Payne place the blame squarely at the feet of the suspects, Brizzi says equally devastating is that despite being in the system, TaJanay had no one there to fight for her. CPS perpetrates more abuse, neglect, and sexual abuse and kills more children then parents in the United States. If the citizens of this country hold CPS to the same standards that they hold parents too. No judge should ever put another child in the hands of ANY government agency because CPS nationwide is guilty of more harm and death than any human being combined. CPS nationwide is guilty of more human rights violations and deaths of children then the homes from which they were removed.
